Indeed it could, because Minnesota's definition of priors for purposes of sentencing hinges not on the date that the prior offense was committed nor even its date of conviction, but instead the date on which the prior offense's conviction reached its own sentencing. This often produces counterintuitive results where even the latter of two offenses could be treated as a "prior" in sentencing for the earlier offense, merely due to happenstance of which case proceeds to sentencing more swiftly than the other:

This is a VERY interesting titbit. Does it also apply to concurrent sentencing? What if Nick is convicted of both counts in the same trial? Does the second get a higher criminal history score?

My logic says, 'no', because that could be gamed, but I want to be sure.

- Kayla was in the car with him during the call-in, and she spoke briefly to say 'hello'.

- Everyone has it wrong. Everyone pretends to care about children, but do not know their names. Dick says that people online are the ones who will ruin their lives so the concern is fake.

- The kids have no idea about internet drama do not totally understand why they were taken out of their home. They told the cops that they had no idea about drugs. The 17 year old supposedly did not know what cocaine even is. Nick had to explain it to him last week.

- People are pretending to be Nick's friends, but they never were. LawTube people are just being jealous. Nick calculated the value of airtime he gave them, and he got 50k USD. Nick made them all from under 1k subs to over 100k. He takes shots at Uncivil Law specifically for being too incompetent to capitalise on the success.

- Nick does not keep a list of grudges against people. He just does not care because he barely talks to anyone, so people who hate him just go away. He has been really busy and ADHD, so he never kept in contact for anyone. He never asked anyone to defend him.

- Nick is very close to a deal in the case, and he thinks that he will come to a deal at his next hearing. Nick has a LOT of evidentiary issues he could raise and hammer the prosecution on. it could be enough to win, but there is always risk and it will cost a lot of time and money. The easiest thing to do is to compromise and make a deal.

- Nick repeats the lie that the State's response to the motion to ask for recording of the pre-trial motions where they said 'there are no victims' and 'children will not testify'., that it means the State conceded the children were not victimised in any way.

- Nick claimed that CPS only wanted 60 days of clean drug tests in order to give the children back because they interviewed the children and found that they were all 'brilliant' and loved their parents, so it was best to return them.

- Nick repeat almost all his copes and the lines he has given before. He is really repetitive if you watch his streams and read his tweets.

- Nick takes shots at Kino Casino and says they did worse things.

- The prosecution KNOWS that he cannot talk about his case until the case is over. A lot of people put private things out in public, and there is a good story that will NEVER be told.

- He says Aaron is hyper-focused on the present and unable to fathom the future. He has supposedly put himself in the position of a hero in situations where it was actually Nick, Kayla, or April who did or said the thing. Nick has a relative that does the same. Nick says the only thing Aaron ever said to Nick about getting physical is that after an argument he 'looked into [Nick's] eyes and [he] was scared'.

- Nick may be banned from alcohol for years, so it will not be a part of the show. Sobriety from all non-prescribed substance is. Nick says all drug testing is inaccurate--except for urinalysis. When you get a false positive, you can do nothing, and you cannot counter-test.

- Nick claims that 1 in 5 children in the USA would test positive for controlled substance. The tests have a 15% error rate, at least. If you tested cops, they would all have results that look like drug users.

- Nick says the State was using the PR aspect of the child endangerment charge to slag him in public and get the deal they wanted. The record only shows that they found a very good and strong bond between the kids and the parents. They will never retract anything though.

- Nick has recordings of the reports and interviews made to police and he could go through those on his show.

- Nick never drank around his kids when he would have to drive or take care of them.

- Nick is planning to go to #FreeRileyFest event Dick is hosting.

This is just impossible to believe. Probably one of Nick's "funny and weird jokes" where his son was telling him cocaine is bad, and Nick had to explain to his son that actually, cocaine is actually AWESOME.

I say this because moments later when they are explaining how they (the adults) went to pubic school and went through DARE, their kids are homeschooled so they don't know drugs. Nick opines that even as a kid he was confused why the DARE people were talking about how AWESOME drugs are, and how "they are so awesome your body will crave them uncontrollably" and he didn't understand why drugs were actually bad then other than "they will kill you."

For concurrent sentencing on multiple counts, they usually start from the most serious charges and work down. So if there are no other priors, first count gets a criminal score of 0, count 2 will include a crim score of 1 (if the first count counts for purposes of the score), etc.

But not a "prior" in the sense that it would move the second count to a different category, for the kinds of crimes that have radically different penalties (like mandatory minimums) for "subsequent" commission of a crime.
