They might not, but they absolutely can. You're just wrong they can't. They have nearly limitless discretion in how to tailor a plea.
Principles matter, but a key principle is doing whats best for the county, and that likely doesn't include dedicating the time to respond to Rekeita making numerous psuedo-plausible claims that require expert witnesess, multiple rounds of lab analysis and a long witness list when the result will be the same: the rich bastard getting a little asspained with no prison time.
And this is why unfortunately such a deal is likely. Even if Nick is an absolute prick and wastes enormous amounts of money for both sides, and gets found guilty, he's still probably looking at a guidelines sentence barely worse than what the deal is. Maybe he even wins and gives a huge black eye to the prosecution. Maybe he gets a little jail in the worst case scenario. Neither side wants to gamble without serious motivation, and this is a minor white trash tard crime.
The best case, at least for our entertainment, is he pleads out on this then they go ahead with the arguably more serious computer felony, at least in the eyes of the law since "cyber" anything is seen as some sort of evil voodoo. Snatch $50 from a cash register when nobody's looking and it's nothing. Steal $50 from an ATM by "hacking" it and you're Kevin Mitnick.
This gets back to Nick's old (wrong) idea that the state has to prove that he used drugs to convict him of possession. They do not.
At most, use is somewhat probative as to possession because if you had no idea why drugs were in your house, the fact you haven't done any of them is at least compatible with that defense. If OTOH you test positive as a heavy drug user when you supposedly had heavy amounts of drugs, well, that defense starts to look even more like a huge crock.
(And if you actually provably did have a huge amount of drugs and DIDN'T use them, it opens up the whole other can of worms as to what you were doing with them, such as distribution.)
