The CPS case didn't "close". Nick (likely) followed the plan negotiated with CPS and got custody of his kids back at the end of just about six months. And six months is just about as long as CPS can usually keep the kids away without CPS doing more drastic things in court. Keeping the kids away for the whole six months means that either (a) the parents are non-cooperative with the CPS plan or (b) they are total shit parents but not so evil that custody can be removed from them.

The idea of CPS cases "closing" definitively forever at a point in time is a self-serving idea that comes from Nick. And Nick is a habitual liar. Nick has continuously lied about everything to do with family court and CPS since he was arrested.

The last "win" Nick probably got in court was getting the family court records related to his family made non-public.

The meth-specific Section 152.137 is limited to cases of manufacture, accessible paraphernalia, and/or a child actually exposed, but with none of that present Jackson wasn't charged under Section 152.137 and instead got plain-vanilla possession and endangerment charges under the same two statutes as in Nick's case:

“[A]ppellant was charged with two counts of second-degree controlled substance crime in violation of Minn. Stat. § 152.022, subds. 1 and 2 (2002), as well as two counts of child endangerment in violation of Minn. Stat. § 609.378, subd. 1(b)(2) (2002).”

The operative statute being interpreted in the pertinent part of Jackson was instead Section 609.035, which supersedes the sentencing guidelines and provides as follows:

Subdivision 1. Conduct; multiple crimes; chargeable for one offense. Except as provided in subdivisions 2, 3, 4, and 5, and in sections 609.2114, subdivision 3, 609.251, 609.2691, 609.486, 609.494, 609.585, and 609.856, and Minnesota Statutes 2012, section 609.21, subdivision 1b, if a person's conduct constitutes more than one offense under the laws of this state, the person may be punished for only one of the offenses and a conviction or acquittal of any one of them is a bar to prosecution for any other of them. All the offenses, if prosecuted, shall be included in one prosecution which shall be stated in separate counts.

That provision standing alone could ordinarily force the judge to select only one Kandiyohi County count to sentence Nick for (customarily the most serious one) even in the event of conviction on all three counts, but fortunately Jackson's interpretation made it clear enough that second-degree possession of any controlled substance and child endangerment by the controlled substance's presence are distinct enough behavioral incidents that they can each be sentenced separately without running afoul of Section 609.035. Jackson would not be quite so on-point as to the gun charge but I can't see what principled distinction would avoid both gross misdemeanors getting the same treatment.

In any event, even with the separate sentences for one or both of the gross misdemeanors tacked onto the drug felony, the main point still stands that his criminal history score in any future cases will not be affected by the gross misdemeanors at all. The only consolation is that his getting two out of the necessary four misdemeanors would crawl that much closer to adding a full point when he fucks up two more times.

There's also NO way that all of his kids tested "above average weight."

Leaving aside the CPS issues, there is no way that's true. His kids are sticks. Plenty of that is likely genetic. Pediatricians use indexes for healthy height/weight and usually report on the day of the check-up. His kids are likely at about 15th percentile - along with a lot of Asian kids and tall Somalis.

I still think back to when he was at his zenith sometimes and am still amazed at how far he's fallen.
