The victim in that RP case is Kayla, because it was her picture Aaron supposedly sent to Geno.
The witnesses are Nick and April.

April verified information (message sent on the date and at the time of the livestream) by potentially illegally accessing Aarons phone records.
Nick and likely April (who might have known the passwords) have accessed Aaron's google account and stolen pictures, videos and if we believe Melton, they also read and listened to lawyer communication.

So yes, the intimidation attempts using illegally accessed data will have an impact on the RP case, because the trial might have been tainted by criminal behavior of the witnesses, to a degree that a fair trial is no longer possible.

Nick and April are not really witnesses to anything. Neither saw what was shared with Geno or can confirm that anything was shared with with Geno. Confirming that Aaron's phone records match the information already provided in Aaron's streaming video is IMO of very marginal importance. They could at best testify to Aaron having been given a nude image of Kayla.

One or the other could provide evidence in the form of stolen phone records. But the only thing that would make a difference is if they had enough evidence to prove that a particular image was sent at a particular time to Geno and to have the actual image sent.

But even if one or the other could provide that evidence, you would never put them on the stand as a witness due to how they obtained that evidence.

I'm not convinced that anything Nick has done would have tainted the case. He has created legal problems for himself, but unless for example he shared information obtained from attorney-client information with prosecutors, I don't see the case as tainted. I think what makes the case difficult is the lack of a witness to confirm that what was shared was "revenge porn" by the legal standard of the law. You could maybe get a lower charge with Aaron's stream content alone, but nothing more than that. A revenge porn case where there is no good witness at all to the actual porn image distributed seems very difficult legally.

Its also possible that Nick and April's behavior could cause prosecutors to drop the case using their own discretion or to plead it down to something very small.

This is my only post I will have. Just to clarify 1 thing. It seems I've confused people about the "investigator" remark. My attorney has his own investigator who looks into new evidence and claims. We are waiting on their official report. Sorry for the confusion.

I would guess "timeliness” (or perhaps previous tardiness) is now one of the things that awoke the sleeping giant.
As a (guarded/kind of/not really/depends on the day) Kayla defender, I'd love to think so. The fact that she was with him when he called into The Dick Show destroys this theory, imo. The garbage he spewed is astonishing.

If that is what is going on. My own pet theory is that Nick is trying to force her to do that by refusing to accomodate her learned helplessness.
This, I believe. Nick's done with the marriage. What Mindset said a couple weeks ago is accurate. The sweepers talking to Nick are clear that he plans to divorce. Nick's just hanging in until the charges are resolved.

Is Kayla prepared for said divorce? Hope springs eternal. I have very little faith. He's publicly humiliated her at every possible juncture. There's no evidence that she's pushing back.

EWWWWWWWWWWWWWWWWWW. WTF!?!
It's worse than I reported. Diameters of both orfices were mentioned. It reminds me of one of the wisest comments of the last couple days:
Aaron's lucky he got entangled with 3 of the very few people near him that are more detestable than he is
I've genuinely tried to like Aaron - everyone makes mistakes. He works hard, organizes his content/clips, and seems truly remorseful. I do believe he's an honest actor at this juncture. Just... he's tragically unlikable and grating.

Nick and April are not really witnesses to anything.
They are listed as witnesses in the complaint. That makes them witnesses, even if the state does not want or need to call them to testify in front of the jury.

What is possible however is, that because they are witnesses and mentioned by name in the complaint, that the defense can call them to poke holes into their story and bring to light their behavior in this and other matters.

At least one of the witnesses also lives with the victim, who they surely would want to testify in courts to the facts of the matter and to be sympathetic for a jury.

How can Aaron ever get a fair trial when the witnesses, who his lawyer would want to question, have read their entire case strategy including questions they will likely be asked and the goal behind those questions?

How can he get a fair trial when every person that could potentially be called to testify knows the questions beforehand and could be coached through them?

"That's why people hire a hooker or go to a strip club. Someone focuses on them and lies to them and makes them feel good. Everybody on earth wants that. You just don't have the money and opportunity to do it."

Christ he's such a NERD! I've been to a strip club with buddies twice in my life.

strip club #1
Lady 20 years older than me bounced my head in between her hard fake tits, that and the combination of cheap vanilla perfume gave me a huge headache.

Strip club #2 (I don't learn from mistakes)
A buddy paid for a lap dance. Girl literally smelled like shit, like she didn't know how to wipe her ass properly.

As for hookers, why would you ever need to pay for sex unless you're a NERD! Rekieta.

I'm happy with my wife, I love her, and the thought of her having sex with another man makes see blood and violence.

Edit: grammar

Yes, and Nick should be punished by it if confirmed but that doesn´t change Aaron´s culpability on his RP case.
No but it makes it nearly impossible to prove if there's no chain of custody on the evidence. And also only the prosecutor has "deemed" him guilty. The prosecutor doesn't decide that.

By cross examination to demonstrate their unreliability and many months to prepare after getting your continuance.

Was Aaron conduct deemed criminal? Yes, regardless if I think it is bullshit or not.
No, Aaron has been formally accused of criminal conduct, by way of him being charged with a crime. He hasn't been deemed anything yet. That's what a trial or plea bargain would do.

Fuckin' Balldoguards and Meltonites are on Twitter calling Sean a traitor and a fat piece of shit every 5 minutes because he dares to tell the truth that a guy who gets caught red-handed with 27 grams of coke in his master bedroom is up shit's creek without a paddle. "INNOCENT UNTIL PROVEN GUILTY, SEEEEEEEEEAN."

Meanwhile, Aaron isn't afforded anywhere near the same respect because "Hail Lord Rekieta." They don't bat an eye at Nick claiming that the State has Aaron "dead to rights."

Snark aside, and because I'm not a total idiot or hopelessly bias, I concede Aaron is probably technically guilty of the misdemeanor revenge porn charge. I'm just not nearly as disgusted with him as I am with Nick given the circumstances of what got us to this point, and the deplorable conduct of the "victim." Kayla ain't Snow White, and Nick could probably care less who sees Kayla's nudes.

Holy shit, yeah since we are at the pre trial phase is pretty much implied his culpability was only asserted by the prosecutor...

I don't. I have no basis to conclude the lewd shit Nick and Kayla were posting around all the time including in public was done in a context that would impose any duty of confidentiality.

I dont think so, I think intent and scope should factor in this and there was no harm to Kayla or the public by what Aaron did. I think it was just a retard being a retard. Aaron a retarded asshole for leaking it nevertheless, but not criminal.

But really, outside some bottom feeders in the dabbleverse (redundant), who would want to have Nick on with them or worse, go on his rotting corpse of a show?
Anybody who's somebody will ghost him after hearing "his daughter tested positive for cocaine", the only thing that's more of a brand poison is if he molested her on top of that. Ironically the best place Nick can warm is Juju's podcast, he'd probably at least consider him as replacement for Sean and it's not like he has any dignity left. Nick achieved his wish of being with Daddy Dax but the djinni was an asshole and will put him there at the nadir and among the esteemed company of heroes such as Juju the Cow, Vito the Pedo, Riley the Pimp and Mint Salad the Pisswhore.

The intent factors into whether it is charged as a misdemeanor or a felony. The rote act of sharing a nude is enough to charge it as a misdemeanor under current MN law. I don't like it either, and it might be ripe for legal challenge (again, given a previous MN law was struck down), but that's the letter of the law they are applying.

Given Aaron is a bit of a dummy (he did it on-air, FFS), I'm prepping myself for Nick to score a minor (and mostly pyrrhic) W here, but I would be endlessly amused if the whole case against Aaron just collapses.

Well, despite all his other faults, he does know OBS kinda-sorta. He wouldn't be the worst replacement for Sean, I guess. Remember that Sean isn't really the TDS co-host as much as the tech guy.

I've long said there's a chance he's gonna end up in Cali with Dick eventually. Especially if he divorces Kayla. I think it's his dream.

Minnesota is increasingly untenable for him. He's in a conservative county, surrounded by people who think he's a POS, and in a state where it's easier than average for him to be sued when he mouths off.

In Cali, people will be more tolerant of his degenerate bullshit, and they have a pretty robust anti-SLAPP.

Moving to Cali would definitely work for him. We are too busy with other insane crap than one studpid coke-head degen from MN!

Edit: AND he would get away from those pesky kids and Qayla!

Hi Aaron. Don't hold yourself to a single post, feel free to shitpost with the rest of us.

Just remember to submit a legal request to Google to grab login info if you haven't already. I hate Melton and wanna see his ass lit up. He also admitted to remoting into Nick's computer so even if you don't see an IP that isn't Nick he's still fucked.

Agreed, but could Nick handle being second chair to a guy who the show is named after? Me thinks his narcissism would only be able to handle about 3 shows of that.

ETA:
Was watching an Elissa Clip of Kino and had a great point via Ralph, that you can't be self-employed if you're on probation? Didn't know this was a thing, but if true, Nick really might need Dick to employ him :really:
