To be completely fair, what happened on December 4th is first degree murder. There was no self-defense component to legally justify the killing, so if Luigi is found to be the shooter, he is guilty of first degree murder. Those of us that like him just agree that he did the world a service and probably should be acquitted on that basis alone.

I don't really understand the "two counts of second degree murder" though. If I'm not mistaken, second degree murder is intentional killing caused by a sudden lapse in judgment, like murdering a man you found in bed with your wife. If he had a spiral notebook with details of premeditating the assassination and a written confession/"manifesto" as the authorities claim, then second degree murder shouldn't apply at all.

The definition of a first-degree murder in New York has a list of specific factors which include such factors as the victim being a police officer or the defendant serving a life sentence. The only one of these factors that might stick for Mangione's case is if the murder was done as an act of terrorism. First-degree murder isn't defined as being based on premeditation alone. A second-degree murder can still have that premeditation factor behind it. The big difference is the intent and/or the type of victim behind the murder.

My legal basis is from another state, that's why I was confused. I did not realize New York state utilized their murder degrees to make police officers an even-more protected class. I assumed the rest of the US also went by the scale of "1st degree = intentional and premeditated, 2nd degree = intentional and a crime of passion, 3rd degree (manslaughter) = unintentional negligence" as is the approximate case for my state.

Interesting. I wonder if and what charges will actually stick.
