Much like Aaron, she's an eyewitness and, unlike Aaron, a personal participant in every aspect of the case, even the part after Aaron committed his one act of prudence and got the fuck out of Dodge.

She saw it all. And she can play the weak, brainwashed woman card about how Balldo FORCED her into sexual degeneracy and TRICKED her into all this stuff. Turn on the waterworks and maybe even play the retroactive consent revocation card, and Nick actually totally MEGA RAPED her.

It will be worse. within hours of pleading guilty he'll say: "What's funny and weird is I don't even remember what the state made me plead guilty to. Sometime a father has to make sacrifices to make sure their children are taken care of. You have no idea what I'd plead guilty to see my kids everyday."

The arguments were actually different. Nick was trying to have the video thrown out in its entirety, leaving the state without probable cause.

He didn't even try to argue that there wasn't probable cause at all, just that it was based on a fake video.

I think it depends on how hardball they want to go. If they did want to go hard on Nick specifically, they'd do them separately to try to get Kayla to turn on Nick or Nick to cave in for an easier deal for Kayla. I don't Balldo is the kind of man to go for the latter because he is weak.

The settlement conference is sort of a formality. It could be to negotiate, and it could just be to put ink on the paper of something that's already been agreed upon. The prosecution and defense don't actually need a formal settlement conference to cut a deal and can reach one at any time prior to the end of the case.

It's not even uncommon for the sides to cut a deal in the hallway outside the courtroom right before the trial is scheduled.
