Yes exactly. Surgeons are well aware that any surgery has risks. If a doctor goes straight to a lumbar spine fusion instead of trying other reasonable interventions for at least a year (other medical imaging, physical therapy, WEIGHT LOSS MANAGEMENT, etc etc) and the surgery fails, they're going to have a really fun time explaining to the patients malpractice lawyer why they bypassed (no pun intended) other methods of treatment.
