Based on the bodycam footage the ideal scenario would have been to do something with the phone and not answer the door. The next best scenario would have been to throw the phone out the door and not answer the door. The next best scenario after that would have been to throw the phone out the door, answer the door and say "If I'm being questioned, I'd like legal counsel present" and close the door again. You can see that what Nick did was far from the best case scenario for his case.

The instinct to not discuss the incident with a responding officer is 100% the right decision, but Nick fell for almost every trick in the book that the police use to get you to talk and incriminate yourself. When you say "I want a lawyer" you should not proceed to stand around outside and hang out with the cops discussing the case, even in oblique details. Not that he knows how to keep his mouth shut, anyhow. Nick saying "I was in fear for my life" and then agreeing with the cop ("right" and "point taken") that he was not in clear and eminent danger does damage to his defense. His defense could have come up with all sorts of kooky shit that could have explained the situation on a more sober day: "Mr. Fuentes thought the phone was a weapon and that's why he disarmed her, and he gave it back when he realized it was not a weapon." Now they have evidence that he knew it was not a weapon and that he was not in clear and eminent danger. Similarly bitching about how people drop by your house could be used by prosecution as evidence that this was an attack made as vengeance against people harassing him day and night, and such vengeance was not done with any justification. This is why you shouldn't talk to cops without a lawyer.

Also, Nick if you're reading this thread to kill time in Room 102 at Maywood Courthouse today, here's a tip for next time. You didn't need to hand over your ID or anything for a "report." You could have gone inside at any time. You also could have stood there silently and not said or done anything. It would've looked mad autistic but it could have kept you from getting snared in law enforcement manipulation.
