Other bits on foreclosure, bc someone mentioned he might not even know about it:

Bc of Reg X/RESPA, he would know about it. The lender has to contact the borrower by phone or in person within 36 days of going delinquent, and again 36 days after each subsequent delinquency, and inform the borrower of any potential loss mitigation options, like a modification, short sale, or deed in lieu of foreclosure. (Unless you're in bankruptcy or told them to stop contacting you, which they must do, per FDCPA.)

They also have to assign you someone at the lender to help you througg the situation. They have to tell you about

• available loss mitigation programs
• how to submit a complete loss mitigation application
• the status of a submitted application
• how to appeal (if the application is denied), and
• the circumstances when the servicer may refer a file to foreclosure.

They also have to inform the borrower in writing of the same within 45 days of a missed payment, at least once every 6 months.

If you're being evaluated for a loan modification, the lender can't be pursuing foreclosure. [This shows that Nick has done nothing about this at all.]

Foreclosure (judicial or non) can't start until at least 120 days delinquency. Thec120 is to allow time for you to figure out a loss mitigation plan/apply.

Borrower can stall a foreclosure by submitting a loss mitigation application before first notice of foreclosure, unless:

• the servicer informs the borrower that the borrower is not eligible for any loss mitigation option, and any appeal has been exhausted
• the borrower rejects all loss mitigation offers, or
• the borrower fails to comply with the terms of a loss mitigation option such as a trial modification. (12 C.F.R. § 1024.41 (2024).)

Even if foreclosure is started, it can be stopped if the borrower submits a loss mitigation application on less one of the 3 conditions above exists.

If your application is rejected, you can bring the loan current and reapply. (12 C.F.R. § 1024.41 (2024).)

I’ve tried to figure out how Nick could be this stupid and why he would have taken out a mortgage in April 2022.

While Nick’s parents appear supportive I don’t think they were ever happy that they bankrolled law school and office rental only for Nick to put in barely any effort for a few years and then announce “streaming” and relying on superchats and Adsense was his new career plan. He also seemed to be blowing money like a retard around this time.

I think the parents might have decided if internet streaming celebrity was really what he was going to do then he needed to it without them footing the bill.

They would bankroll the fail son college, law school, small town lawyer career but not the internet lawtube one. (Plus he already had been gifted two houses by mom and dad). Maybe mom and dad cutting off the free ride was the worst day ever?

The timing of loan is odd, but it occurred right before his biggest 18 months as a streamer so it’s insane he didn’t pay that off or way down. He started living large imagining that cash flow was only going up up and up. But it went down so fast he stopped paying a collateralized mortgage over a year ago!! Mortgages are usually the first priority.

It’s still mind boggling he could burn through that much cash but cocaine, booze dumb lawsuits and stupidity can do it.

I thought Aaron’s comments about Nick “canceling meal plans” was just faux belt tightening convo but I believe Nick would cancel Hello Fresh and not pay a mortgage while giving his side chick his other house for rent free and paying a lawyer tens of thousands for a retarded defamation case he should have settled.

Nick won’t lose the house. Mom and Dad will save him if he doesn’t get the cash from the other free house sale fast enough to stop the foreclosure. However I’d bet he did not want his parents to discover he took out a mortgage on the #2 house they gave him because it just confirm what a retard he is and they were correct about the long term prospects of his internet streaming career.

Also there could be some level of fraud involved with him obtaining a mortgage on a house the trust owned. I think they had structured the trust owning the house to try and prevent Nick doing something stupid with a house they bought him.
