Is Austin going for a sanity plea? Is he going actually crazy in the jail waiting for trial? This is highly unusual for a simple drug posession. Either he's down bad in the mentals while incarcerated, or his Attorney is trying this as a hail-Mary as along with this simple drug posession comes a felony violation of his probation from the car breakins in 2015 (and potentially its 5 year prison sentenc).

Maybe it's both ? His lawyer is trying to get him off but also this is really the first time that Bossman has faced real consequences for his actions.

This is unlikely. Something like 70% of all inmates have substance use disorders (SUDs), the mostly deadly of which are alcohol related; this is usually where you'll see medical intervention. You usually don't have access to psychiatric treatment.

Generally, if you say you're feeling suicidal in jail, they'll just throw you naked in a padded room, until you can be evaluated. Some jails have areas specifically for mentally ill inmates (homeless, crazy, schizophrenic, actually damaged people), but being put here is generally FAR worse.

Incompetent to stand trial isn't the same thing as insanity either, it basically puts things on hold, if I understand correctly.

No, it just means they're not wasting time with a formality. They can challenge the evidence later, but they're not challenging its sufficiency as probable cause to go forward. Most people waive the preliminary hearing.

Almost always, the prosecution just brings the cop to the stand to say some stuff that almost always constitutes sufficient probable cause. It's a waste of limited time and resources to bother with a hearing that has about zero chance of actually improving the defendant's situation, never mind that the prosecution can use it to bring additional charges (not sure about Virginia specifically).

So very often, insisting on a prelim has near zero chance of improving your situation and a substantial chance of making it worse. In those cases, counsel will advise waiving it.

Also if you're planning on taking a plea anyway, you just want to get straight to that instead of messing around in court even more.

ETA: not really disagreeing with you, just clarifying that the defense isn't waiving all evidentiary challenges doing this, just waiving any claim that whatever the prosecution presents constitutes probable cause, which it almost certainly does.

The true story is that Boss peacefully turned himself in after hearing vicious rumors about his character. He wanted to give the authorities the chance to discover this was all a campaign by Big Crypto Casino to smear him so they don't have to pay out his rightful winnings. The story that he was a belligerent little shit weakly calling for his mom while pissing his pants and ranting about binning the rats is a complete fabrication.
