I'm not "dooming" if I'm genuinely against a policy. All the messaging that is coming from them about the H-1B is incredibly dishonest. The H-1B doesn't need "reform" to "guarantee we get quality people" because the visa to get quality people already fucking exists. It's called the O-1A. The J-1 visa also exists to poach academic talent. The H-1B visa criteria means that it's applicable to any position that requires on paper a bachelor's degree. That is a program that simply doesn't need to exist.

I confess to have fallen for that dishonest argument. That it only requires undergraduate education makes much more sense and why it is so easy to game. I don't think I've met ever met a "best and brightest" H1B visa holder, just pajeets. The few Indians I've worked with that were worth anything were either long naturalized or here on some other visa.

The troubling thing is that due to a lot of reasons (CRA shit included through competency tests) we've created a "system" that is almost impossible to back away from. Any job that actually requires you to have some kind of brainpower is kept behind a bachelor degree-minimum and thus it makes it really easy for a company to game that through an H-1B visa application.

Again, this is all a misdirection. The H-1B was NEVER used for highly-skilled people. You don't need to be a highly-skilled person to possess a bachelor's degree. That's the criteria for it according to the Citizenship and Immigration Services. It does, to be fully transparent, note "Theoretical and practical application of a body of highly specialized knowledge" as another requirement but that could literally mean anything. That's vague as hell and anything can be highly specialized if you word it right.

Also, even if we limit it to "highly skilled", they will still be willing to work for cheap compared to their American counterparts because they are getting paid with a visa. We have plenty of people with potential who are disillusioned due to DEI and H1B limiting their career prospects before they even really start. We need to tap into our own talent first before we start poaching from other developed countries.

The main thing in the way is the companies not wanting to pay for local talent over white collar slaves and the execs + HR are too ignorant of the work in question to realize there's a problem until it hurts the bottom line, where they will then, on recommendation from the H1B people (Indians), hire more H1B people to fix the problem that is the H1B people.

We need to tap into our own talent first before we start poaching from other developed countries.

Most Americans almost certainly agree but companies would rather try to save money by paying for cheap foreign labor. The companies need to be dis-incentivized from doing this and, ideally, not even be able to bring in foreign labor without it being a major headache of justifications on their part. The real justification is simply "they're cheaper" while ignoring that they're not just low quality, they're dangerously incompetent.

The thing that gets me about all the Trump lawfare is how obvious it is.
