Dropping in to say that I want everyone who neg rated me when I said Patrick had a case to eat shit. I don't care about stickers so much as I really enjoy being right.
I still maintain that as soon as one moves away from theoreticals, there's no real case. Yeah, okay, cool, false calls can impact probable cause. but how does it work in practice? The Judge is silent on that one (to be fair, the Judge need not address it at this juncture)

No stalker, there is very much a case here, that is incredibly relevant in the digital age. Anyone, from anywhere, can access the publicly available information about anyone in America due to the USA's incredibly loose public privacy laws with regards to everything from voter rolls, property deeds, criminal history searches, the sex offender registry, privately owned civil electrical monopolies selling their nigger cattle's addresses and names to data brokers...etc...

This case while ultimately based around a retard is actually VERY relevant for modern jurisprudence. And honestly it is one I want him to win, in order to set the necessary precedent. Simply put, it is very easy to "Sunshine" an American citizen. Whether this is good or bad is immaterial. What is material is that it allows ANYONE with a bare bones knowledge of how to do research of publicly available data to attempt to kill someone by police, or at the minimum, subject them to a potentially compromising search of their domicile.

Now, isolated incidents of this could be ignored. But Tomlinson was not subjected to isolated searches of his property or physical detention. Neither was his wife. They were both subjected to repeated searches without warrant, and repeated detentions without warrant. It is important to bear in mind that the moment a Police officer tells you that you cannot be in a place, and must be in a place he tells you to be in, this is detention by State authority. No cuffs or guns are needed. Simply a verbal command that you must be somewhere, anywhere, at the direction of the officer. Cuffs and guns are simply more physical tools of getting this done.

There is definitely a civil rights claim here, and one that probably needs to be pounded into common law. Patrick's weens were very helpful in this regard.

I'm not sure why you're harping on 'warrant' so much given that you can be detained without need of a warrant by law enforcement.

Patty's criminal history would certainly be noted by police. Patty's foul mood would also be noted by police and, in instances where he was being combative, would definitely be noted.

Extenuating circumstances and reasonable suspicion are both grounds for someone to be temporarily detained. As is detaining a 'mentally deranged person', as cited in Bisgaard v. Duval:

It is well established that an insane person, without any adjudication, may lawfully be restrained of his liberty for his own benefit, either because it is necessary to protect him against a tendency to suicide, or to stray away from those who would care for him, or to protect others from his assaults,

(I'm only really including this 110 year old case law for comedic reasons, but you could make an argument that Patty in full on oinkout could constitute someone who was mentally unwell and would require being restrained.)

The fact that there were only 7(?) instances where there were issues and multiple other instances where nothing happened would also be in favor of MPD. It is possible that there might be a dickhead officer who was causing Patty grief, and that probably is grounds for a civil suit (IF such a thing happened and it wasn't Patty being Patty.)

But otherwise, the only other recourse appears to be doing what Patty wants, and to be put on a super-special 'no cops please' list where they have to know the secret password and handshake. Which is fucking ludicrous, especially given Patty has been arrested for threatening to kill a loved one.

None of this really matters to the legal standing of Porque Squealer's case, though. I'd also argue that the issue is less to do with publicly available information and rather the ability to spoof phone numbers and 'safely' call 911 for swatings.

From public info we know the following:

7 counts he is alleging.
Count 1 - TORSWAT* #1 : His very first swat. Pat alone naked on the porch pig. probably shouldnt be counted, it was the first swat as per his own filing: "Plaintiffs do not allege that the responding officers knew of the swatting situation when they arrived at the home." Officers: at least 4-6 maybe more as per Alivia report (source of audio for that night).

Count 2 - TORSWAT* #2: Same as above with just Niki home. Its not reasonable to have a "system" in place at this point. Officers: Plevak

Officers are just doing their job up until now

Then we have:
Count 3 - TORSWAT* #5: Niki (the alleged victim) answers the door. The officers order her out and search the home briefly. Officers: Kohler, Wasecheck, Mustafa

Count 4 - TORSWAT* #17: Same as above. Niki answers but is not alleged victim. house is searched briefly despite pat whinging over the doorcam that they need a warrant. Officers: Evans, Garrido, Orlando

Count 5 - TORSWAT* #25 (approx) Same as above, This is when niki filmed him being beligerent (ie the real reason he was threatened with cuffs that incident) Officers: 6 including Carelton (also from niki video its clear Evans was there)

Count 6 - TORSWAT* #27 (approx) essentially same as above. Pat would only talk to them over door cam, niki who was home was silent. Evans asked for proof of life from niki. when refused, threatened to kick door down. Niki shows herself he leaves. Officers: Evans, Peterson

Count 7 - TORSWAT* #29 (approx) Same as above but both were home. They refused to come to the door to show they were ok, Evans threatened to kick door in, they come to door, he leaves. Officers: Evans, Vento

Was Evans being a dick? maybe.
Could it be argued he is just covering his ass? Easily. All he wanted was to secure the premises and see that occupants were safe and alive. No damage to property was done. No-one was hurt. As soon as he could secure the location he left. If the occupant hadnt been so beligerent and non compliant it could have been done in 10% of the time.

Pat having Main character Syndrome assumes that all the police everywhere at anytime will know his situation and if not should act deferential to him as he is more educated in the matter. Real life doesn't work life that.

I'm sure when Pat was conversing with the officers just trying to do their job over the ring cam that he was polite, level headed and compliant.
