Mercy was given when this case was dismissed under rule 12b(6).

It was the Plaintiffs decision to escalate the case

Okay Greer. You have all these witnesses. You have all this electronic evidence. You told the 10th Circuit of the United States you had it. Lets see it! And what does the court get? Nothing.
[...]
Congrats Greer. You are the dog who caught the car. Now enjoy being run over.
Great post, that first sentence in particular struck me.

It inspired a consideration on the "Internet Nigger" theory by Dear Feeder, I'm not sure I can put it to words:
the judicial system maybe is using the resilience of Defendants and the fact that no one in "polite society" will shed a tear to KF (even unjustly) suffering to finally brutally punish Russ for his legal fuckery.
As if it was the Anvil to finally hammer the Retard down: who is going to protest if the Anvil gets hammered in the process also.

Maybe it's too romantic, maybe it's melodramatic and a bit "parasocially histrionic", probably it's 🌈; I just like the aesthetic of the thought.

Congratulations Hardin, Moon and Kiwi Farms (a website) on this battle won.
Get fucked Shitlips, you get what you fucking deserve.

For those who enjoy UM's many contributions and haven't seen, they're nominated for Best Overall Contributor in the First Annual Buford Awards.

Our boy seems to be killing it but that's not a reason to not get out there and vote if you haven't done so.

Very excited to read Greetard's reaction. I don't think Null is gonna get his full money back though; I hope he does but I think Greer is too broke and prideful to pay it all back.

He should go to his family and have them pay it for him.

i know its broke ass russhole were talking about but a couple thousand in discovery costs after 4 years of shitlips wasting everyones fucking time and poisoning the air with radioactive tism spittle is far from brutal. the predecent set by this case for other retards looking to follow suit (pun intended) is still bad. nulls goal is to mount such a defense that discourages others from trying to do what rusty is doing and this judge is making that really fucking hard.
a truly brutal (and deserved) punishment would involve dismissal with prejudice, declaring russhole a vexatious litigant and awarding full costs to nool for all 4+ years, basically equivalent to the judge saying "FUCK YOU you get nothing you idiot, eat shit". additionally such a punishment will need to survive appeal in the 10th circus which gives zero fucks about anything because they are so far removed from the reality of how much of an asshole russ truly is
i dont think theres any way russ can win this suit but i doubt the outcome of this will be the final blow to russell greer the desert dwelling sexatious vex pest in any meaningful way

So, what do we think Russ' reply will be? Things I'm hoping for:
  • Russ brings up the money Hardin supposedly owes him as some sort of gotcha
  • Russ is TRYING his BEST, he GENUINELY DIDN'T KNOW he wasn't supposed to do those things! Give him a BREAK!
  • More emails of Hardin being mean to him
  • More whining about Kiwi Farms when it is not even remotely relevant
  • They're just picking on him because he's disabled
  • Telling the court he's homeless while continuing to use an address he does not live at on his filings
  • Sent from my iPhone
  • Insulting the judge directly
Of all of these things, the last one is the one I'm hoping for the most. The rest are pretty typical Greer plights and whining, but if he moves up to outright calling the judge stupid it will be really funny.

I'm also going to predict that Greer and Hardin will not come to an agreement re: costs, Hardin's offer will be whatever and Greer's offer will be "no, YOU pay ME," so the judge just arbitrarily awards something in the end, making him even more pissed off with the case.

As I make these predictions, we must all remember that Greer is a maverick and we must unexpect the expected when dealing with him. He could do everything I predicted or none of it. Regardless of how many of my predictions come true, it will be entertaining, and that's what's important.

What I'm curious about is whether this development will cause Russell to view the judge as an adversary rather than as an ally. Will he pivot to attacking the judge, or will he continue his approach of tattling on Hardin to the judge?

Another possibility, and I view this as extremely slim, but it is something I thought about, is he tries voluntarily withdrawing the lawsuit now to try and avoid fees. If I were a betting man I wouldn't bet on this but he did voluntarily withdraw a lawsuit relatively recently to avoid showing up to court iirc.

I could imagine him doing that and expecting not having to pay the fees, not that it will help but it is possible he thinks it will

If that's the case would the lawyer firm that got him that appeal in the first place be in trouble at all? They may not be involved in this mess and they only argued this in order to get that sweet copyright precedent but would they not seen all the apparent evidence and witnesses Russ had and helped him to commit prejury? Or can they claim to be not responsible for how he's been doing this case?
They had nothing to do with any of that. They were just arguing about the sufficiency of the complaint.

I did appreciate that even the Judge came out and told Greer that Hardin did in fact not violate the protective order. Basically just one step away from telling Greer he's a fuckin moron who couldn't figure out how to mark documents correctly.
I now expect Greer to include the magical incantation of the SPO intending for it to protect the entirety of every filing going forward, and then when the filing gets posted un-redacted to PACER, him filing to the judge of violating his own protective order and working with the Hardship.

No joke, I'm pretty sure all of these (maybe except the insult) in a "please reverse the motion" motion. Not like he could lose anything by filing it.
Actually he could lose a lot by filing it. If what other users have told me is true, he’s now working on Hardin’s time. Since the precedent is set that Hardin should respond to everything Greer submits, Hardin will need to spend billable hours responding to Greer’s motions (within reason).

Any fighting that Greer does could waste more of Hardin’s time and Greer is getting billed for it. He could be upping the costs by hundreds of dollars depending on how much he’s kicking and screaming.

So, what do we think Russ' reply will be?

An appeal on the grounds that the judge is misinterpreting everything Greer did, that pro se filings are supposed to be interpreted liberally and this applies to retarded emails from their iPhone too. Greer is doing his best, all these emails with Hardin are proof of a good faith attempt to comply.

In fact all these emails and frivolous filings are proof Hardin is trying to confuse Plaintiff so that Plaintiff can not possibly comply, and any non-compliance is Hardin's fault, sanctionable even! The judge is being unsympathetic, and this order is encouraging even more hate and harassment from Kiwi Farms, a website. (Exhibit D: email message from Russ_got_sanctioned@cock.li)

And even if all the above doesn't work, Greer is poor and evicted and pro se and disabled so he shouldn't have to pay more than just the filing fees. Really no harm was done, so no punitive fees are warranted here. When the 10th Appeals ruled that Greer totally has a real open & shut winning case, Greer was only awarded filing fees, and so it's only fair that any sanctions against Greer be restricted to filing costs as well. Also Greer finds it very ironic the defendants are asking for money when they still haven't paid what they rightly owe DJF Greer, like this saintly Court already ruled last year. WHERE'S THE $225 HARDIN, COUGH IT UP
