On a first-foot basis, "reasonable hourly rate" would be whatever Mr. Hardin usually charges, provided it is not in conflict with with rates provided by lawyers of reasonably comparable skill, experience, and reputation for similar services.
Poor Greer, I think Hardin is one of very few lawyers in the united states experienced and skilled in dealing with the legal troubles that come with the unique position Dear Feeder is in. Maybe he is the only one truly qualified. There's nothing like the farms and no one else like Josh.
 
Hopefully no one since he’s going to be in multi-generational debt at this pace.

While I do hope that will be the case, as that's best for everyone (including Russell himself), I think he loves the idea of being involved in legal disputes. Because he failed to become a paralegal as a career, he's doing it now as a hobby.

This case previously crapped on online freedoms - by destroying Fair Use and propping up insanity such as - "my copyright is infringed by you posting a link...".
Was that 'undone' ?

Did this judge dismiss with prejudice?
No. The shitshow continues. The costs being awarded to Josh are just the legal expenses for dealing with Russell's non-disclosure of evidence and witnesses.

No such determination was made, as a preliminary matter or even as a definitive ruling.

While true, I'm not sure that would be entirely a factor. He could certainly make that argument, but I don't see much success.

Indeed. This is a Discovery Sanction. Incidentally, the judge never did give us an update on whether he thinks Russ complied with Rule 26 (specifically he refused to do so for now), so Greer is still on the potential hook for dismissal as a sanction

Greer might not have much worth taking, but I bet his ailing parents do. I hope null devours his inheritance.

I can't believe we didn't get a fresh new filing this morning. We know he can't possibly be coming to his senses (because he has none), so I'm forced to assume he's hatching some new sort of gotcha scheme.

Maybe he did realize he can just sue the judge, and that'll immediately halt all proceedings including already-ruled-upon sanctions.

Presumably he's just working on his appeal to the Supreme court. Why bother with the circuit court, they've already agreed with him so they'll let him just appeal straight to the top.
 
With this case ending in the presumably foreseeable future, I wonder where we'll get our dose of Russell's life updates. Main Greer thread is very slow, as his only online activity is basically responding to bots on twitter. And constantly delaying his album. I feel for Null for going through this ordeal, but this thread has been invaluable for Russell's sperging. Who will he sue next?
I feel we're due for a "Russ sues his way into k-pop" storyarc.

We're almost at the end of the beginning. 4 years. Russhole has delayed this shit for 4 years until Hardin reached out (after hiring a fucking PI) to Russ's witnesses to subpoena and depose them, they discovered they were on a witness list of a lolsuit, and Russ panicked and fucked up and mentioned he has no witnesses and no evidence.

Actually, I'm not quite certain what case he has at that point. Like, I mean, procedurally. Not merits. "I'm suing you but bringing literally nothing to the courtroom to have the truth of it evaluated." Ok, what then? He comes out, shovels pity for a few minutes as an opening statement, rests his case immediately?

The Judge should immediately toss this. No evidence, no witnesses. What's left for a finder of fact to do?

We know he doesn’t have evidence. We’ve known since this started Russ is lying when he said he has evidence and witnesses. However in court documents Russ still claims to have evidence of contributory copyright infringements. I’d say unless Russ comes out and says “your honor I don’t have any evidence or witnesses I just want to hurt josh for letting people laugh at my antics” the judge is gonna drag him to trial where he will bitch and moan about how mean the kiwi farms is before it gets dismissed again.

Well, depends on how it gets kicked, but, generally, yes, though again, depending on the nature of the dismissal (or the cause) he'd have a much harder or easier time on appeal (and appeals are hard to win in general)
