He would be a witness on Nick´s case, it has nothing to do with Aaron´s where he is obviously the accused.

Of course it has something to do with the case, because the accusation made is that Nick/April/Kayla/Melton (which you can assume are a conglomerate here) had access to the confidential communication between Aaron and is lawyer.

His chances of getting a fair trial could be close to 0% thanks to that.

Accuser: Kayla is the damaged party because of whom the state is bringing the charges
Witnesses: Nick, April, Geno, Keanu

"Hacking Case" accusation: Nick, April, Kayla, Melton (and possibly others) either had direct access to Aaron's Google, Social Media and YouTube account, which contained confidential communication between Aaron and his lawyer about the defense in the Revenge Porn case.

It is further possible that the confirmation of "a message was sent by Aaron to Geno at the time and date matching the livestream", was also only possible because April had illegal access to Aaron's mobile phone records after or during the divorce.

It is also possible Geno and Keanu were told about the information Nick had access to illegally.

All of the above directly tie into this Revenge Porn case and compromise due process. That is why the results of that investigation are relevant.

If it can be proven the witnesses and victim in the RP case were reading Aaron's communication with the lawyer I expect the case to be dismissed.

What's the timeline on the revenge porn and the unauthorized access? I'd throw out a case just because all the evidence is compromised if the witnesses for a crime involving the internet are themselves under investigation for having illegal access to all of the accused's online accounts.

The evidence is Aaron allegedly sending the pic on camera to Geno, the qualifier is if Kayla waived her right to privacy by spreading her nudes around. The hacking would be relevant, in my mind, if Nick used Aaron´s devices to send the picture passing as him.

Sure, if Aaron´s lawyer is half competent, Nick´s testimony would be void but he is not essential to the case. I also agree Aaron should get out with a misdemeanor or get the whole thing canned, I just dont think any of Nick´s behavior that was discovered after Aaron committed the bullshit crime should excuse it.

Oh absolutely no one should be excused. They are a qover of a qlusterfuck. The issue that has to be unentangled is that Nick was listed in the complaint as a witness. I think Nick would plead the fifth with all the other stuff he's facing. I believe Nick is the one that retrieved the image that Kayla shared so he's the link that connects the image Geno saw to the image Kayla sent. They have to get that image into evidence through testimony and Nick or Kayla would be the ones to do it. Once in evidence as a nude image of Kayla taken by Kayla, Geno would testify that's the image he saw. As far as we know, Geno has never seen Kayla nude so he wouldn't be in a position to say whether the image was actually Kayla, taken by Kayla and sent to Aaron. The state has to prove a number of things including who is in the photo, when it was taken, that it was shared with Aaron, that Aaron shared that specific photo with Geno, that it was intimate photo and that he didn't have permission to do it.
