TBH, I fully agree with the decision to not accept a plea.
They need to get an entire jury to agree that sending a single picture to a friend who subsequently deleted the image counts as "revenge porn".

Geno isn't testifying, nor is Keanu. Aaron didn't say during the stream it was a nude. The right to confront your accuser means the prosecutor can't use the Keanu streams unless she testifies.

Unless they managed to get that photo from the phone company I really don't see what they could hope to prove.

I suppose the defense is that we're going to inject the issue of Nick's ongoing unauthorized access and gayops and raise the specter of "how do we know that Nick didn't send those images to Geno while impersonating Aaron as a frame up job"? Frankly a good defense, depending on how far they let you go into the issue it does a good job of showing the jury how much of a "victim" they really are even if the jury does think you technically sent the picture they might just say "fuck Nick and Kayla anyway", or say they're degenerates with no expectation of privacy in the picture.

This of course won't matter because the letter of how a law is enforced (or explained to a jury) often runs far afoul of the original intentions of a law.

I think the argument is more likely going to be ‘it was shared with my willing by the parties involved and I only shared it to someone to prove what I was saying was true while Nick was lying aubout everything.’

They also probably need to do it without a witness to the photo as sent. Under badly written minnesota law, sending a single image to a friend does count as revenge porn. But the tricky thing is how you establish the photo and its contents beyond a reasonable doubt without a reliable witness to the photo.

Investigating this kind of bullshit takes ages. First they need warrants for the data, then the company has to compile it and send it over, then they need someone competent in the field to have the time to go through the data and then request further warrants for more accounts information and data, then compile their findings and potentially even give the info upstairs because there are federal jurisdiction implications here because of the laws broken and multiple people across state lines being involved.

It is entirely possible that its a big fat nothingburger and nobody will ever get charged though. But that depends, in my opinion, primarily on what data they accessed.

If the prosecutor doesn't have Geno and they don't have the photo plus a forensic expect who can make the chain from Aaron to publication to another person I don't see how they could possibly have a case.

The chain of custody on any evidence on Aaron's devices is broken. It was accessed by a relative of the "victim." So unless they can prove specifically what was sent entirely from uncompromised devices, the "evidence" is worthless. Has nothing to do with witnesses.
