Wouldn't it be illegal to use something that's not rightfully yours for yourself? Documenting it surely wouldn't help the case.

unfortunately, an "inheritance" is the property of the testator/benefactor, not the beneficiary.

It depends on what kind of "fund" was set up. You can set up funds with specific universities, different banks will have accounts specifically meant for education funds, and some people just open a different checking or savings account with the intention of using it for their kid's college someday. If it's the latter, there's not much the daughter can do (especially if her name isn't on it).
