Air Traffic Controllers aren't. Controlled Airspace isn't.

Once you tell ATC in visual conditions that you have the traffic you're not supposed to hit in sight, then it's your problem(the pilot). ATC might get some blame for not giving direction and heading to the target they weren't supposed to hit, but this one is probably 95-99% on the helicopter.

Whatever the truth turns out to be it's absolutely suspicious that the female/"female" black hawk crew member's identity hasn't been released yet. It would be one thing if none of the crew's names were released since they could do some "national security" hand waving, but omitting only one name is not a good look and is certainly making me assume there's either a political (read: troon or coon) reason to hide or they somehow know they were the one at fault and need to do some damage control before releasing the name, or both. Not sure why else they would be hiding that info.

So the ‘female’ pilot actually flying it isn’t identified, the ATC are getting blamed, but the ID of the helicopter pilot who seems to have flown straight I to the side of the plane is withheld so it looks like the man in the article was flying it when you read the article
