Nick is funny. The word "imperative" is on the subpoena form. They don't have a case without Geno.

Now what Nick is claiming can be one of two things. Firstly that Aaron had a copy of the photo and message on his phone and handed it over to the cops, either forcefully or voluntarily and lied to people about losing his phone several days before his arrest warrant.

Nick conflates April's access showing a message was sent as evidence that they have evidence a nude was sent.

Well. Given that Nick is himself an attorney and had the right & ability to review the motion before submission, all this does is raise the question of why Nick would allow what he knew to be a "poorly drafted and unclear" motion to be filed on his behalf. As a sometimes-attorney, Nick can't really claim ignorance of process or the contents of the motion.

He is though doing more than just throwing the Barneswalker under the bus. Going forward Nick will undoubtedly now still claim that the warrant was obviously invalid due to all the arguments in the motion that was failed. Nick will still be right about everything as regards the warrant. It will be only poor communication skills that prevented the judge from ending the case before it started and forcing Nick to have no option other than to plead guilty.

I am not sure how much the decay of Nicks brain have progressed, but it seams like it is only kept alive on cope and sneed at the moment.
I wonder if Nick even knows how authenticating evidence works anymore.

Assuming Aaron sent a nude picture of Kayla, and assuming it could be construed as revenge porn. It sounds like Nick believes he can anonymously send his dumps of data gotten from his unauthorized compute access and have that come in as "evidence". It will be no way to authenticate it. Only direct phone dump, carrier data, or data directly from FB or other messaging service, authenticated by the ones doing the dump would be admissible.
