Well if the public develops certain expectations for how such businesses should operate and the business fails to meet them and backlash ensues due to low public confidence in the business is this not a massive failure of the business to appeal to its market audience?

Also why should businesses wait for the government to catch up when they could easily be profiting from providing a better service?

No, it's a failure to have a market. The health insurance industry is basically impossible to enter because of the amount of government red tape it takes to start an insurance company. There are luckily examples of insurance-free doctors, like some in Oklahoma and Mexico, but until the government cuts the red tape, the healthcare industry will remain a monopoly.
