Inquiry: If someone marks a document as confidential and for attorneys' eyes only, can they break the confidentiality whenever they want? Can they break the confidentiality they themselves have set up?

Probably but not necessarily.

Technically, once something is (legitimately) marked for the SPO it shouldn't be "unmarked" without both sides agreeing, but Hardin has already registered his "this is bullshit" complaint, so even if Greer shouldn't then publish it, he probably can pro se get away with it.

Some excerpts from the scheduling conference I found interesting. I read through basically the entire thing picking out things I thought were interesting, other users might have found other and more interesting things.

Greer just can't let the other causes of actions go. He cannot accept that he lost on those.


The judge is very optimistic when compared to reality.


This is really funny because the Judge knows this case is going to be a hassle. But I don't think he knows just how bad it is going to be.


Hardin is a good lawyer and Null is lucky to have him but one disadvantage he has is that he does not know Utah's rules perfectly.


I don't get why Hardin argued this one with the judge. I mean yeah it is true but the judge already ruled against him on this. I don't get it but that might have more to do with my lack of understanding of the specifics of the legal process.

Something that should make every poster here feel a little better and Null feel better too. This Judge is suffering with this case. I can feel his despair and his desire to get this case moving along and over with. But that is not going to happen unless the judge actually does what he is supposed to.

Reading the transcript, Hardin the Hardship has stated Greer's loss of earnings is not because Kiwi Farms has infringed on his copyrights, but rather, because Greer makes very poor financial choices. The court's response?


Russell's response? Demand to be allowed to explain!


The court lets him, but also clarifies what, exactly, they want him to explain:


For those who don't know, for damages in a case like this you estimate potential loss of revenue and demand that from the defendant. For example, if I sold a book for $10 and someone pirated 100 copies, I could ask for $1000 in damages, since that would've been the revenue I missed out on.

Greer does not know what the market value of his own work is.



Even with the judge's kid gloves, he cannot state how much he wishes to seek in damages. So, naturally, he was given until the 31st of December to amend his claims:
