I am curious what makes one "a kiwi farms person"? Is it a state of mind? Does it require one to register, read and post on the notorious stalker website? Is anyone who ever trolled on the internet a kiwi farms person? If Shannon Howe has never visited the Farms would Russ' statement be considered defamatory? If a clerk at a mail store won't comply with Russ' request to defer payment on his box does he accuse him of being a kiwi farms person?

It's a state of being. Like Heaven, or Shangri-La, or the bedroom of a consenting, uncompensated female.

Do you think Russell knows now there was no restraining order, even though he was ordered to give it, so he's just giving Hardin the case number to offload the burden of finding it on him? Then he can say "The restraining order is totally real and I told you where it is so it's YOUR FAULT if you can't find it!"

Might also be part of his monkey see monkey do legal strategy. Just like quoting show cause because it worked on him, Hardin and the Judge have repeatedly told him where to go to read what he needs to do, and he refused and has been sanctioned for it, so now he thinks he can give Hardin something to look up and say "HA! You didn't even look it up when I gave you the link so I caught you!"

He doesn't seem ti understand that when the court orders him to produce something that doesn't mean point vaguely at a place where it might be.

Yet another indication that he is in way over his head or that he is doing everything in his power to stop the endless pull of the void, slowly dragging his precious lawsuit towards its inevitable conclusion. When told to produce documents he himself should be holding his response is to tell both judge and opposition, 'its in this pile of shit, go find it yourself, asshole.'

I think you're being too charitable towards him, and are attributing things to his stupidity instead of his malice. I know, Hanlon's razor and all that, but for Russ this is pattern of behavior, not a one-off incident. It happened so often that the Judge himself called his recalcitrance willful.
There is no doubt in my mind that Greer is doing his very best to stall for as long as he can and cost Null as much money as possible; up to and including instructing Harding to spend money on Pacer to acquire documents that shitlips should provide himself.

This is worth 2 demerits. Be better! :feels:

He never actually ruled on the 5k indicated by Hardin. The District Judge jumped in to cut it down to 1k before the Magistrate had a chance, so we don't actually know what number he would've hit Greer with. Could've been the full amount, or more, but I suspect it still would've been less.
Probably, but seems likely he wanted for Greer to understand the impact of fuckery and at least use it as another brick toward a solid case for increasing amounts for the inevitable future sanctionable behavior and to support escalating sanctions.*

I know it's frustrating for people to see the faucet drip of impacts on Greer, but if I were a judge/ magistrate in the derpy 10th Circuit with an appellate court that kept this thing alive, I, too, would be compiling a mountain of evidence of plaintiff's self-imposed plights and self-determined idiocy, even after being given every possible benefit of the doubt.

* The problem with the ultimate sanction - dismissal - is that the 10th Circuit said Russell wrote down words for one count that did not completely fail to include the words that the statute requires you use. Now, Russell thinks that means that the Circuit Court looked at his complaint and said "sounds like you win this one, buddy boy," which of course is not what their ruling said or meant. However, for the magistrate and District Court, this means dismissal for sanctions prior to there being something to review to consider whether there any facts whatsoever established - which requires discovery - is, especially with a lunatic recalcitrant plaintiff, very unpalatable. They are trying, against Russell's best efforts, to get something to look at to see if there's even anything to decide.

I hope the judge finally tells Russell in plain language "You have to provide all the documents, and pay for them yourself, even if it costs $100 and even if Hardin asks for 20 such records!"

The judge is a huge fuckup for not ordering an involuntary psych hold when Russ pulled that shit about how he didn’t think he would kill himself. Dr Now ordered a psych evaluation of Lisa Fleming when she pulled that on him when she was all out of ideas and manipulation tactics. Imagine how it would have looked for that judge if Russ wasn’t lying and did that after threatening to do it in a filing.

If Russ kills himself, he'd commit perjury in doing so
More sanctions, let's see how he gets away with that

So catching up with everything. Basically Greer says that the documents are easily obtainable from PACER so for some reason that means the he doesn't actually have to get them. Then for the other two users that he wants to add in, obviously he'll just say that since they're on Null's site then Null should do Greer's job and serve them, even though one user hasn't logged in for years and Null would just have the IP address for the other that isn't identifying by itself.

Court: give Defense the document
Greer: (gesturing at PACER) "it's right there!"

Hardin: give me a paragraph cite
Greer: (gesturing at the entire SPO) "it's right there!"

the Law: point to grounds for sanctions
Greer: (gesturing at the entire Utah Local Rules) "it's in there!"

It's almost certainly people who dislike the farms and are trying to stir up trouble (no shortage of those) or russ himself. I mean, "kiwifarms1@tutamail.com" saying "DIE" with 20 exclamation marks? That screams fake to me in the same way ole' bitch-tits-tomlinson having someone write "gay" in dry erase marker on his house screams fake.
Odd he's never produced a police report about these. Even DSP went that far.

In the case of “Greer cannot process more than one thing at a time, in a strict FIFO”, the prosecution rests.

For Rusty it's more of a DIGO situation, Data In - Garbage Out

"Greer is a human being who simply wants to move on with his life."

Yeah, like the idiot bank robber who wants to get ten miles down the road before the dye pack pops.

What a fucking liar he is.

I agree, calling himself a human being is a bridge too far.

Assuming the amended complaint survives a motion to dismiss (this seems reasonable since the district judge + magistrate seem too afraid of the 10th Circuit to toss the copyright claims) will Null be obligated to help Crusty Rusty unmask the new Doe defendants, and is the case against Null and the Farms paused while attempts to serve the Doe defendants is ongoing?

Not a lawyer here and it seems unfair to proceed against Null when the Doe defendants and their actions might be relevant to his defense.

This feels like a repeat of the witnesses debacle, and Hardin knows it. Russ trying to drag people into this that he can't actually follow through on. Hope it ends up adding to the bill.
Russ will plightsplain that null knows who the 2 users of null's website are and that it's null's responsiblity to serve them because null has the evidence. and since null hasn't served null's users, null is demonstrating that null is a bad man who is hiding evidence from the court and that merits sanctions so null has to pay greer the 1000 + the previous court fees. and since greer is suing kiwifarms users that means greer is actively persuing greer's lolsuit and it is right and just.

Feels like this case might be stalled even longer with all this now happening. What happens if neither Greer nor Null\KF can identify the new defendants (I'm assuming that KF doesn't have such information)? What happens if he CAN serve them, at this very late stage (where they may be severely prejudiced by the lateness)? Discovery has somehow barely started after years but this could multiply the complexity- and the costs (which may increasingly become an issue for Russ, as he is only starting to find out, despite him being a pauper).

I was semi-joking way earlier in the thread when I suggested that Russ might get hit by a bus before the lawsuit ever got to trial but I'm starting to think it's more of a possibility...

Only SCOTUS has the legal authority to force Null to reveal user information. Greer will have to hope he gets lucky and they grant cert in the next session. He should probably collate ALL of his relevant screenshots now and be sure to include them with his petition.
You’re forgetting the other option.

Since the court can rule that service was not completed, they obviously know how it should be done.

So Greer can just serve the court itself.

It totally works but lawyers won’t tell you about it.

What user information. Null has clearly stated policies about what he does and does not log and for how long. Unless they used their @russelgreer.com email addresses to register there is not much for Null to hand over. It's not a Russel type "dog ate my homework" excuse.
