What's gonna happen here (and is, in fact, happening) is that he and the Balldoguards are gonna claim, from now to the end of the world, that Nick never endangered his children because they dropped the misdemeanor enhancement. They'll claim (and are claiming) that they couldn't prove the misdemeanor, or he never committed the misdemeanor.
In reality, they dropped the enhancement to get him to plead to the felony possession on the basis of time and money. Nick took that deal because he knows that the most damning thing he did here concerns the kids and he's guilty as shit.
Somewhat counterintuitively (based on the felony vs misdemeanor difference), I think a lot of people view the misdemeanor child endangerment charge as more vile than the felony possession. This is because if Nick possessed and used coke away from the children, this whole thing would more funny than disgusting.
I don't
like what the prosecutor did here, but I get why they did it. That's how these things often work. Judicial economy. Why waste the time and money on two misdemeanor enhancements if he'll cop to the felony without a fight?
If Nick tries to sue anybody for defamation because they say he put his kids at risk, he'd lose badly because them not pursuing the misdemeanor enhancement doesn't change the facts of the case.

So, Nick's story has indeed changed in the time from when the report was filled out. And fairly recently, at that.
It's looking to me that when the prosecutor told the judge that it was
imperative that Geno and Keanu testify, they weren't kidding. It's possible the Signal shit isn't as important as we were led to believe, and they can't build a case around it alone.
As to whether it makes any difference how Aaron got the picture, one thing I would point out is that if the picture wasn't shared via Signal, the whole thing in the police report where it says it they all agreed there would be privacy in things shared via Signal wouldn't necessarily be applicable here.
Does Kayla have a reasonable expectation of privacy if Aaron took the picture and this had nothing to do with Signal? Probably, yeah. Or, at least, think a jury might conclude that. Remember, I think Aaron may be going down for the Misdemeanor on this. However, their Signal agreement as outlined in the police report wouldn't be directly relevant to that.
If what Kanoe said is true, that there are so many nude pictures of the Qover that trying to find one specific pic of zonked out Qayla is like trying to find a needle in a haystack... well, not gonna look great to a jury if Aaron can get that into court.
Somebody suggested it would be funny if Aaron called Coomalot to the stand. Per him, Nick shared nudes with him. Although I can't remember if it was just April, or April and Kayla. IIRC, he claims to have definitely seen April.
I firmly believe both Nick and Aaron were BOTH like "hur duurrr, look at this piece of ass I got!"
I dunno if it would be allowed, but it might damage the narrative that any of these idiots had any reason expectation of privacy.
