You're conflating laws with morals. And yes there's often overlap and underpinned morals to laws, but they are distinct things. Legal is legal, and not is not. I agree Nick shouldn't have gotten the deal he did...but he did.
What Kandiyohi prosecutes or not has nothing to do with Stearns County. Both have county attorneys with prosecutorial discretion independent of one another.
Prosecutors also often take cases forward for things or scenarios not previously tested. That's how law develops.
The problem Aaron has is that it's not his first rodeo. Surely you can imagine that from a prosecutor's vantage point he looks like a serial harasser who won't leave his exes alone.
They still have to show intent to harass or actual harassment (which does often take into account how it affected the victim, so assume Kayla (and Nick) will play that). Did anything we saw when Aaron sent the pic specifically indicate an intent to harass? I don't think so. And I don't think any past acts are sufficiently similar to be admitted to show a pattern of behavior, but you never know. Either way, couple doing it publicly [though I note that he did not, iirc, say what it was he sent when he sent it, so that undercuts the argument that the public way he shared it reaches harassment...though maybe not all the way] with testimony about how it made her feel unsafe in some way or other, and it's potentially tricky.
But being cheated on does not undo an otherwise actual crime. The whole point of statutes like this is to keep scorned and disappointed people from punishing former lovers by sharing intimate images. If you said, "well, he was mad for being dumped, understandable" means the action isn't actionable, then there would be no teeth to the law; 99% of revenge porn is by mad exes.
And people throwing in "woman power" just bc the ACA in Stearns is a woman, or a woman who has stated she cares about crimes that often get overlooked or passed by, are being retarded. Put your dick back in your pants, because we've seen more than enough of them waving around in this saga already (by Nick & Co.).
I don't agree with pushing hard on this as a felony, afaict, and I get it looks stupid when compared to the severity and outcome of Nick's and Kayla's crimes, but that's not the prosecutor's problem, and she's not a dumb broad for making an independent judgment within her sphere of discretion. If you want to insult her decisions, fine, but it's weak and lazy to tag it to her being a woman.
