That's not exactly how it works. With the Human Rights Tribunals, there will be a free "legal clinic" (like what Alejandro Caballero works at in the States) that will offer a one-hour consultation for free advice, to both complainants and respondents, run by some activist lawyers' society. In reality, this one-hour clinic is a screening process to identify those cases which the society would want to take on pro-bono to advance the vision, mission, and values of the society. Essentially, they only ever take on a complainant's case, because those are the only ones that reflect the missions of the societies that run these clinics.

This is proper big boy court as well, not some faggot run HRC case so I'm pretty damn sure that they won't accept "Trannycard" to excuse non payment of mortgage.

Looking at the figures involved alongside his work history (patchy and bottom of the ladder) it wouldn't surprise me if some sleight of hand was undertaken to obtain a mortgage in the first place, which could explain him not taking up the 6 month deal that was offered to him a while back.

Like a lot of sub prime borrowers he likely used his IT company to generated a bunch of fake invoices and or contract payslips to satisfy the income part of loan servicing requirements. In the last 2 years the regulatory body has tightened loan applications to manage povvo defaults. Aspirational buyers hardly ever factor in higher interest rates. Foreclosing and selling for 75cents on the dollar usually recovers the debt but borrowers rarely get any equity back. Yaniv will be wiped out.

Not true in Jon's case.
He certainly has a car (not sure if it's owned or leased though) and a strata apartment, so there's some money floating around there that the courts could force him to release.
You can take that in Canada?

In the US you can't take the following:
Primary residence.
Primary vehicle.
Any sort of tugboat. (Disability/welfare/any kind of gubment check)

Except in Canada it's backwards, where filing a human rights complaint against someone results in the state providing you with a free lawyer, but not for the defendent.
In the US you can file the lawsuit yourself pro-se, which doesn't even involve court fees if you're poor enough if you file the appropriate 'im poor' forms. Meaning it costs you literally nothing, while the people opposing you have to waste at least one, if not multiple of the following:

1) Their own time.
2) Their money, if they aren't homeless tier poor like you are - they HAVE to pay the court fees even if they choose to defend themselves instead of spending MORE money on a lawyer.

Then, when they beat you: they get nothing because see the above.
 
Unlikely. The mortgage company just want to recover their outlay so will sell it at whatever that balance is plus their costs.
They'll also want a possession order before sale. When the court grants this, things move fast. Jonny is a hoarder so that should be fun for all concerned.
I hope he kept up with his car payments* because he's going to be living in it.

However, it has to be fully owned by the person with the debt, if it's on finance then the car doesn't belong to the debtor.
Having said that, I imagine Jon would have bought the car on finance, so we can only hope he has been defaulting on those payments as well.

There's a lot to pick apart in the foreclosure pleading - but there's some salient facts in there, along with some process facts:

  • 14% interest rate, and it's accruing daily. The interested is compounded on the balance.
  • The balance owing - as of Feb 28 - was $318,552.88
  • The assessed value is $422,600.00. While that's for tax purposes, there's a general trend in markets as to whether homes sell for under or over assessment. Right now, condos of that sort are going for a little below.
  • Court fees, foreclosure fees, real-estate fees (traditionally seller pays in BC - 7% on first $100k and 2.5% on the remainder) will be deducted from the proceeds
BC has both "insured" and "uninsured" mortgages. If there's a shortfall, Yaniv is responsible for making it up. If he can't, and he has mortgage insurance, they'll pay but he has to go bankrupt. To top that off - the vehicle is almost certainly leased. Which means it's owned by the leasing company, not Yaniv. Don't pay, they repo it. Try to hide it, it's a stolen vehicle.

Now - Yaniv can save his bacon by paying off the existing mortgage. That means getting a mortgage from another lender. Usually when you're in this spot, you wind up with a "last-chance" style lender. However - the lender he's with is exactly one of those. He has no chances left. He's fucked. Mama Yaniv almost certainly will wind up selling her condo and they'll have to move somewhere cheaper and get a two or three bedroom place together.

You get the privilege of driving it and treating it as your own for the duration of the lease (3-5 years). Stop paying the monthly lease? They come collect. Hide the car? It's a stolen vehicle, and you'll get nabbed by the cops.

This is true except you can apply for a waiver of fees if your poor and can actually file a lawsuit. Unfortunately ppl can abuse this

Don't. Don't feel bad for her, not even a little bit. Miriam is just as bugfuck as Jon is; she's a crazy, incestuous bitch and she is thoroughly responsible for how he turned out. Sometimes good parents end up with bad seeds from no fault of their own, this is true, but not in this case.
