It all rests on what "lawfully authorized investigative, protective, or intelligence activity" means. Does the act in itself create a lawfully authorized activity? I can clearly read it as such. What about investigative, protective, or intelligence activities? Police, for example, are allowed to lie to you to force out a confession, and are allowed to fabricate evidence to place officers as your cellmates in order to trick you into a confession. It is not a stretch for the DoJ to read this act as permitting (or not forbidding) forgeries. And trust me, they will make this argument.
