A rough idea of how President Trump could go about this situation if he wanted to play dirty:

1.) Impeach the rogue judges. Putting them through the process is the point, not conviction.

2.) Effectively abolish said judges’ district courts by an act of Congress made in the background of the impeachment process. This could be done one of two ways:

a) By budget reconciliation to defund the specified district courts.*
Or
b) By outright abolishing the district courts in question through killing the filibuster.*

*Either of which are dependent on the Republicans in the Senate and House being in lockstep, which is obviously not the case at the moment.

3.) Arrest judges who try to impose injunctions on said Act of Congress.

4.) Invoke the Insurrection Act to clean up the aftermath, or help complete Step 3.

I’m no lawyer, so please highlight any legal/logical errors, aside from the obvious constitution crises this would raise (on top of the current situation).

Do I think this will be the case?

I would hope not, given the Left’s propensity to violence, but time will tell.

Though, another thing to consider is that the pressure the Judicial Branch could face from steps 1 and 2 might be enough to rein them in.

Section 3

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

So I see the good Behavior clause, but I don't see where a simple majority of both halves of Congress can remove said judge for Behavior that is not good.

That's not at all what the clause is saying or what it's for. It's to establish that judges may hold their position for life. What would the point of impeachment be if a simple majority without the complexities of impeachment could be done? The clause doesn't grant Congress any additional power nor does it provide a mechanism for removing a judge who may be outside 'good Behavior'. There is solely impeachment or dissolving/reorganizing the district via act of Congress (which does not technically require 2/3s majority).

The left has been using the courts for decades now to get what they want, instead of convincing voters and using Congress. The courts SHOULD have told them to fuck off and settle political questions politically. Unfortunately judges were more then happy to usurp executive and legislative power.

It was only a matter of time before a President came along with enough political capital to tell the courts to go fuck themselves. That what has really got the left upset. Not a break with norms. Not defying the rule of law, but rather their preferred method of imposing top down control over the country is being foreclosed.

They're mad that Trump and MAGA are using the left's weapons and tactics against the left. This isn't about the rule of law.
