If this is true, then we should expect to see at least some discovery occur.

The "lie" he referenced is almost certainly about the timeline; he said she lied on the complaint "to even make the filing possible," and filing in a federal court would only be possible if the federal statute applies. A small or imprecise lie in the complaint wouldn't deprive the court of jurisdiction over the case (I guess, depending on the "lie," but the timeline is the only thing I can think of).
