Apparently I need to belabor my point, but per the government itself the only thing preventing SNAP from being used for excluded items is the cashier themselves making sure the items scanned are coded properly. They choose how to code it, and with a wink and a "don't tell anybody!" to poor Daneexuaah they can put whatever they want through it. The government has neither the time nor the resources to pursue every single instance of this happening or audit it in a reasonable fashion, so it's mainly up to the stores themselves who I can tell you aren't going to be the ones to fess up and tell the government they did a no-no and to fine them.
