He concluded Billy got paid money, claimed so in his video, was told that was not true by Billy, Keemstar and Billy's lawyer, claimed he would only re-upload the video if he had solid proof, uploaded it again.

He had no solid proof for the claim that Billy received money as part of the settlement. AFAIK the Australian judge could read that settlement, it is mentioned in the ruling, and found that Billy was not paid money by Apollo Legend and the ONLY reason why Apollo would ever be forced to do so was if he violated the settlement agreement.

The point at which Karl is told "that is untrue", is where he should have thrown himself on the ground and kowtowed to Billy begging to not get assraped in court.
Because Karl KNEW that he had no foundation for his claim, he knew he would lose in court, and then he lied about it to his viewers to make money from both videos and a GoFundme for legal cost.

Karl has insisted on that lie being the truth for nearly 3 years. He deserves the loss and he deserves to lose his viewership. His credibility is done for. He needs to go find a job at McDonalds or as a hot-sauce salesman for Billy to pay off his debt.

[EDIT] And I am upset I ever believed that storyline, because it appears there is information out there that puts a lot of things in question and suggests that other people, previous friends of Apollo, might have played a much bigger role than Billy ever did. But Karl and the other Drama Tubers did not cover that information.
You're correct but from Karl's warped perspective cheating on Donkey Kong is worse than causing Apollo's suicide so I suspect he's still perplexed at the verdict.

In Australia, Billy would not have to prove actual malice or economic damages, which is why he chose to file the suit there instead of in the US.
Ignoring economic damages, the standard would be definitely be higher in the US, but malice was listed as a factor in the Australian ruling. I don't know if it was a necessary factor or an aggravating factor but I think he'd have lost that in either country because of his behavior. The judge hated this Jobst guy for being really annoying.

(d) Mr Jobst’s conduct since the first publication of the video, including during this
proceeding, has been aggravating and has caused additional personal hurt and
reputational damage to Mr Mitchell.
DEFAMATION – DAMAGES – GENERAL DAMAGES – ASSESSMENT – IN GENERAL – SPECIAL MATTERS – AGGRAVATION – the plaintiff claimed aggravated damages – the imputations were based on a fallacy – the defendant repeated the publication – the defendant used extravagant and sensationalised language – the defendant had malice towards the plaintiff – the defendant’s conduct of the litigation was aggravating – the retraction video did not demonstrate a genuine apology – whether the defendant’s conduct was aggravating in the circumstances – appropriate measure of aggravated damages.
Mr Jobst also has a self-aggrandising and perhaps self-protective tendency not to
admit error and not to back down once he has taken a stance. This trait was clear from
a number of things arising during the evidence. I have already mentioned one: his
response to Apollo Legend’s announcement of his settlement with Mr Mitchell:
“Dont (sic) worry guys. I will never back down.” He also demonstrated that trait in
his videos about Mr Mitchell, continually calling him a cheat and asserting that his
legal proceedings against others (and against Mr Jobst, in this proceeding) were
frivolous, bullying and bound to be lost by Mr Mitchell

They also had to teach the judge what reddit is because Karl's source was a reddit comment, which I'm sure earned him even more ire of the judge.
In his evidence, Mr Jobst was asked about his basis for stating that Apollo Legend had
paid Mr Mitchell a large sum of money. Apart from Apollo Legend’s public statement

about his settlement with Mr Mitchell, Mr Jobst said he was also aware of a post on
Reddit that had been made several days before the settlement became public, in which
the person posting said something to the effect, “Karl’s playing a dangerous game.
Billy forced Apollo Legend to settle and pay him money.”
It is apposite at this stage to set out the evidence about Reddit. Relatively early in the
trial, Mr Mitchell referred to Reddit and I, revealing my ignorance about such sites on
the internet, asked what is Reddit

There's an easy way to answer this: dump the subtitles files of all of his videos from YouTube and just search for the word suicide and you'll be able to find out pretty quick whether he mentioned it or not (unless he had it on screen and just referred to the visual aid without saying the word)
The lawsuit mentions Karl Lobst (get it?) cutting certain references of Apollo out of his video after BM released a response video. I don't know how that affects Youtube's subtitles but I can give you a list of every time Apollo was mentioned in my own transcripts.

I'm also going to argue that he expressed joy at the thought of the YouTuber ApolloLegend's death.
This is obviously a terrible thing, and not only did he imply he was going to smile and giggle if ApolloLegend died, but he also said that he hoped it was true.
This was in 2018, which was two years before ApolloLegend actually died.
At this time, Billy had only heard that he had died from his wife, and he was gleefully
texting about it to his friends.
Billy's defense to this is that Apollo Legend didn't die until 2020, so Billy only thought
Apollo Legend had died, which makes his text okay.
Yes, this really is Billy's defense.
I'm also going to show that Billy abuses the legal system to try and silence people
and force them to recognize his scores.
For example, when he threatened Guinness World Records with a lawsuit if they didn't reinstate
He has to show that something that I said wasn't true, and that it was defamatory.
I said wasn't true and that it was defamatory.
He then needs to prove that his reputation was damaged by that specific claim, and has to prove those damages.
From my side, I'm going to argue that what I said wasn't defamatory, that Billy's reputation was already terrible,
and that I've said so many damaging things about him that were true, and that I can prove,
that even if he did show that one thing I said was wrong, it didn't make a difference.

Billy himself has already proven that his reputation was destroyed long before I ever talked about him and he proved this by suing Twin
He sued Twin Galaxies for $11 million in two states. He sued Apollo Legend for $1 million and he sued Jeremy Young, Jeff Harris and the Donkey Kong Forum for $3 million.
In all of those lawsuits he claims that his reputation was destroyed by their statements. He can't have his cake and eat it too.
He can't say that Twin Galaxies destroyed his career in his lawsuit in America and then come over to Australia and say that his reputation was amazing and I destroyed it once again.
That doesn't make any sense, but that's exactly what Billy is doing.

When Billy settled with Guinness World Records, they made a statement.
When he settled with Apollo Legend, Apollo made a statement.
And when he settled with Twin Galaxies, they both made a statement.
Daily settlements always come with a public statement, and the fact that one is absent
here is further confirmation that a settlement never happened.

Here's probably the most clear reference to Apollo's suicide, as well as him introducing the "GoFundMe to support victims of Billy Mitchell's frivolous lawsuits". Which as far as I know (please don't sue me for defamation) it was only Karl Jobst that tapped into this fund.

He also sued YouTuber Apollo Legend for $1 million. I haven't spoken about this publicly,
but this lawsuit ultimately ended with Apollo giving in and settling with Mitchell. The lawsuit
against Apollo was just as frivolous as the rest, and Apollo definitely would have won in court,
but again, he was extremely ill and couldn't handle the ongoing stress.

Mitchell threatened to sue Guinness World Records, causing them to cave in and reinstate his fake
scores. He also hired a lawyer in Australia and threatened to sue me, trying to extort me for
$150,000. In all likelihood, if he's not stopped he probably will sue me eventually. And now of
course, he is suing David Race for exposing him and helping Twin Galaxies with their lawsuit.
It's really important to remember that Mitchell has never had a lawsuit actually go the distance
and result in his favor. In the past people would get too scared and comply until he went up against
the new owner of Twin Galaxies, Jace Hall, who is anything but a pushover. The only lawsuit that
actually ended in a judgment was Mitchell's lawsuit against Cartoon Network, which he hilariously lost.
And trust me, he is going to lose every single lawsuit from here on out. People are fed up with
being pushed around and they are beginning to fight back. Unfortunately fighting requires money,
Which is why I have launched a GoFundMe to support victims of Billy Mitchell's frivolous lawsuits.

People loved hearing about the crazy things that speedrunners had discovered.
In late 2016 and early 2017 more channels started gaining popularity. Channels such as EZscape,
Apollo Legend and Summoning Salt, the latter of which creating a documentary series outlining
the world record progressions of popular speedrunning games, which millions of people
have watched and loved.

Back in May I talked about the new lawsuits filed by Todd Rogers and Billy Mitchell.
In that video, I made the claim that Apollo Legend paid money to Billy Mitchell as part
of their settlement.
I would never make such a claim unless I had very good evidence to support my position.
In response to this, Billy Mitchell released a video accusing me of lying and claimed that
no money was exchanged.
He didn't provide any evidence to back up this claim, nor did he attempt to get in contact
with me to clear up any misinformation I may have had.
However, I did investigate further as I would never want to provide false information to
my viewers.

I reached out to a member of Apollo's family who graciously agreed to clarify some details.
According to them, despite Mitchell's best efforts, Apollo Legend would not pay any
money and in the final version of the settlement, there was no clause indicating that he was
required to do so.
Therefore the statement I made in that video was almost certainly incorrect.
I sincerely apologize for providing false information, and no matter what kind of relationship
I have with Mitchell, I do not believe that it is ever justified to lie or mislead.
Mitchell also claimed that I was accusing him of murder.
This is certainly not the case.
I do have my opinion regarding the impact of the settlement on Apollo's decision,
but ultimately it was no one's responsibility but his own.
The only reason I mentioned it in that video was because I felt like it was important to
let you know what happened, as I know many of you enjoyed his videos.

I also attached the transcripts from his videos uploaded yesterday. It should have all of them that were still up as of 4/1. Just for fun, I have 1173 hits for "Billy", 28 hits for "Apollo", and 10 for "Raid Shadow Legends".

This is part of the quote the judge uses in the ruling. Karl claimed that, removed it from the video, then reuploaded it after he was told that claim was false, then removed it again later.

He was forced to remove all his videos about Mitchell’s cheating and paid him a large sum of money. This left him deeply in debt, which required him to find extra work, but with his ongoing health issues this was all too much of a burden and he ultimately took his own life."

During the trial this is what Karl had to say in his defense how he came to the conclusion Apollo must have paid Billy.

How can you go to trial with that being your defense for not apologizing and properly retracting what you know and later admitted was likely false?
That I had to read the judgement to find out about how deep the deception went is really enlightening about how Karl ran this entire thing.

Nah, I don't think that holds water. Karl knew the loser would be taking a huge financial hit. The cost is probably far more than he raised. I think he actually expected to win, hired a yes-man lawyer who was gassing him up(after rejecting the one Notch offered to pay for), and expected he could milk his lawsuit for content and then have Billy pay for his legal fees.
 
I'm getting a little lost on the back and forth, correct me if I am wrong on this summary of the cheating scandal.

  • Billy is an actually good gamer who set legit records in the 80s and 90s.
  • He was a major supporter of twin galaxies, who handle record keeping of high scores of retro games.
  • Some of his later records was set on a machine with non original parts and Billy entered the score under the original cabinet category, and his support of TG lead them to help cover it up.
  • This got uncovered and has caused decades worth of tard rage ever since due to the scandal and Billy's many lolsuits that followed.
And to anyone who knows how time consuming finding and installing genuine parts for old Arcade cabinets is it's entirely understandable why his machine might not have been 100% original. The only really bad thing he did was colluding with the judges to lie about ti.

So DarkViper writes a hit piece on a mentally ill man who then names DarkViper in his suicide note, Karl Jobst decides to knowingly and maliciously claim Billy Mitchell is somehow responsible for this suicide as a means to cover for DarkViper so that DarkViper would have more time to write 14 pages about how watching videos without consent is the same as rape.

This is considered okay and supported by the "commentary community" and moistcritical because Billy Mitchell once cheated in a videogame and looks kind of silly.

He figured Mitchells reputation was so bad (from playing donkey kong wrong) that he could freely accuse him of driving a man to suicide, bait him into a lawsuit, and then use it to hurt Mitchell more while enriching himself through donos.
