Nick's doing linguistic jousting with literalism again and taking advantage of the fact the questioner asked the question in an inartful way. Nick's entered a guilty plea to a third degree felony. But rather than answer the spirit of the question (i.e. "was the crime you are guilty of a felony or a gross misdemeanor"), Nick has deliberately focused on the literal way the question was phrased, which is not the actual intent of the question (i.e. "what are you going to be convicted of on Thursday"), so he can answer no.

The distinction is that Nick has already been convicted. Nick is being sentenced on Thursday. So Nick is saying that he's not being convicted of anything on Thursday.

Typical jackass behavior.

The thing is, between what Aaron said on his show, and the fact that elb confirmed that Nick was taunting her that he was reading her mail (really stupid on his part), the whole hacking discussion understandably just got a shot in the arm.

Plus, independent of any any legal consequences, I 100% believe he obtained unauthorized access to one or more of Aaron's cloud accounts (presumably Google). Chalk up another example of him being a complete PoS.

Only because that's never been tested in court. For good reason too, the gov't would lose. There's a reason Glenn Greenwald and every other person who has reported on unauthorized info is still walking among us.

The portions of the CFAA covering knowingly transmitting, retaining, or using information obtained through unauthorized access are very real and have been used in court many times.. As I already said, they are not used against journalists and they are typically used in situations where there is a financial gain associated with use of the material. But if you are not a journalist and can't credibly show a journalistic use for the material, there are potentially serious legal consequences associated with this.

But again, prosecutions for this sort of thing are rather arbitrary. Even if there is an investigation showing serious wrongdoing, the decision to bring cases is rather arbitrary.

(note - I changed "serious legal" to :potentially serious legal" because there is no certainty of prosecution in cases like this.

I doubt a guy (Melton) who repeatedly goes in hard on pedophilic sexual insults to Aaron's children, encourages police reports to make false police reports, uses "AI" to make sexual insults against his children, etc. can really claim a "journalistic" purpose for what is obvious harassment.

This may not be an international cybercrime ring, but it certainly isn't the fucking Pentagon Papers or anything.

I think that take is 100% correct. I don't think there's any doubt that Nick did something illegal with Aaron's account. I also think it's pretty clear from what Melton was saying, at least before Nick decided go full retard and expose his own crimes, that Nick had forwarded material to him too. I simply think people should slow their roll about speculating about what prison Nick is going to without any confirmation.

I've also stated repeatedly that Aaron should file an ethics complaint based on the fact that Nick publicly claimed to have spied on Aaron's attorney-client communications. That's in his power.

Circling back to my original post about this where I CLEARLY say the person who accessed the data originally and put it into the public domain is guilty of multiple crimes. The other people who then accessed it after those crimes were committed, not so much.
Probably. An exception is likely Melton, since Nick had ongoing access and Melton knew, which he was good enough to boast about and also post a sample of.

Other than that, I don't know how other people used the information.

Nick's defence is going to be it was all okay, because Aaron left himself logged in. That's a completely retarded argument. Worse, he made it in video already.
