This has been my read of the bodycam footage as well, sadly. The law is probably overly restrictive, but I don't know this would be the best instance to try to set precedent.

Then there were the letters from Kayla and his father which IMO did him a whole lot of damage through their lack of any remorse argument and their obsession with Nick as a hero fighting for freedom.

The reporter Wil Herren tweeted that Rekieta's sentencing came as a surprise to him because "a source" (probably Rekieta himself) told him that he would not face any jail time. He then retweeted Rekieta announcing his new show.
