It's worth noting that a 21 month suspended sentence is the guideline sentence here, although I believe it's only suspended for 21 months. In that sense, he got off light. His anticipated prison term when he fucks up probation is only 30 days. However, his probation is 5 years long. That is so much worse for Nick Rekieta. The guideline sentence gets him back to his drugged up and deranged lifestyle in less than 2 years. This is 3 more years of the state breathing down his neck. I think that's why he took a victory lap over "getting off light" despite being a cuck of the nanny state for 5 years.

This is not correct. The 30 days in county jail has nothing to do with his sentence as he hasn't been sentenced. His guilty plea has not been accepted. It's been deferred. It will be dismissed if Nick complies with the courts orders. That order includes 30 days jail (may be deferred), community service, probation, etc, etc.

If Nick fails the above terms, the court can then accept the guilty plea and sentence him. The presumptive sentence is 21 months in prison (not jail) if the court goes that route.

Also, the probation length is 5 years but the court can shorten it. It is very likely that if Nick has a clean probation after 21 months, the court would likely end probation. Sean and the Barneswalker in his memorandom noted this.

It appears the court uses the long times (30 days in jail, 5 years) as big sticks. The court MAY defer the jail time and MAY shorten probation while he is still in deferred adjudication.

No, the timeline does not match up, and this has been discussed at least twice ITT in detail. It is most likely NOT the child who had an issue. The follicle testing is only really accurate out to 3 months, and the 'medical emergency' was more than 3 months before the testing was done.

Now Barnes has retroactively changed his argument to have been: "Nick needs to bring up a whole bunch of constitutional challenges so that the prosecutors in the case offer him a great plea deal."

So all of the badly drafted motions by Nick's side that completely failed in court somehow forced prosecutors to give Nick a great deal. And if anyone calls out Barnes on this, he will just come with a new story about how he was right all along.

And in Barnes world, any charge that was dropped in the deal was obviously a charge where Nick was going to 100% win and the state had no case. Nick's children are just great and Nick is a great dad. And according to Barnes, the prosecutors at sentencing somehow completely exonerated Nick from doing anything wrong with the children.

What's wild about dui guy is that he is more successful than nick at this point.
