This is the "Memorandum of Law" that supports their motion to dismiss from March 28th that was not available on Courtlistener because Ron decided to comply with the Bundling practice the judge wants.
Alyssa's lawyers did not do that and instead uploaded their motion to PACER. So Ron published this for us to peruse.

1. No personal jurisdiction because the law they cite explicitly excludes defamation
2. All claims made by Mercante are defamation claims (some dressed up as something else)

Just for the record and to avoid confusion, that text about being "a significant figure in the original Garmergate." isn't from Alyssa's complaint, but from the defendant's motion to dismiss; it's not a deliberate lie but it is incorrect. I don't think I've ever seen Alyssa directly claim she was heavily involved in Gamergate, but she more or less implies it constantly; I don't really blame people for thinking so since she worked at Kotaku and speaks about it like a Vietnam veteran every time she can.

After she was fired by Kotaku she quote tweeted a Hasan fan twitter account which said the following: "For those confused on what’s happening, Destiny’s community has engaged in a mass harassment campaign against Hasan by spamming emails to Twitch’s advertisers and the ADL, accusing him of anti-Semitism. " Alyssa responded with: "Several weeks ago they [Destiny's community] spammed kotaku staff and g/o editorial leadership. they need hobbies."


According to the amended complaint, Smash JT apparently "knew" that his audience would accuse Alyssa of antisemitism. There are three problems with this accusation:

1) First off, it's contradicted by Alyssa's own admissions in which she admitted that the reports were coming from Destiny's community.

2) Secondly, in the video and article Smash made about Alyssa's simping of Hasan, using as a source Destiny's Imgur album, he never mentions anything about antisemitism or accuses Alyssa of that and he shits on Destiny in his video. But according to Alyssa's lawyers Smash making a video mocking Alyssa's simping of Hasan means that Smash "knew" that his audience would accuse her of antisemitism while never providing proof to support that claim.

3) When she announced that she left Kotaku she portrayed it as leaving by her own volition which contradicts the narrative in her original complaint and the amended one.

I agree, she has no chance to prove it unless someone at Kotaku will swear under oath that SmashJT is responsible and explain how and why, and provides internal emails to prove this.

Blaming someone who makes "journalism" who is reporting on an evolving situation for harassment and losing her job, is just dumb. Especially when she actively put herself in that position and lost her job like so many other people simply because she is a supporter of Islamic Terrorism and openly stating it on social media.

But this would have been the one thing where she can demonstrate real financial damages by blaming him for losing her job and future job prospects due to reputation damage. That her own tweets disprove her claim is certainly hilarious.

Edit: Im no lawyer, but I'm very confused as to why L-Lyssa filed an amended complaint instead of a reply brief.

Because the complaint was hot garbage that was going to get dismissed or outright sanctioned. The best outcome would have been dismissal on jurisdiction.
