I refuse to watch Willy's video so maybe he asked whether Destiny had consent elsewhere, but Destiny didn't even have to "dodge" that question in the text messages you shared because Willy never asked it. For the Melina audio (yes the other woman is Melina), I actually could see that one being consensual, as you can hear it quite clearly, but as Melina has said, even if he recorded that one with consent, he didn't have her consent for sending it.

This is all part of the "implied consent" argument he keeps bringing up. He knows he had no consent at all, so he cannot say anything that might indicate that he knew he lacked the consent to share the recordings before the porn leak occurred. I do not think it changes the fact that he committed a crime, but since they did not go for an early dismissal it makes me think that tiny will admit to sharing the recordings as an "honest mistake" instead of what it actually was (leaking intimate recordings without permission).

Yes, he's mentioned this a few other times that I recall. He seems to think it makes a difference to people that he was in the videos; he mentions in Willy's video that "other people" think that's a "really big point," but I'm convinced those "other people" are just himself and his most devoted cultists that think this fact is somehow relevant to the allegations against him. Like, yes, I suppose if he was sending around videos of people that he did not participate in at all, that might make him a shittier person than he already is (and I'm not actually convinced that he has not or would not do something like that), but the fact that he is in the videos that he unconsentually sent around doesn't seem to make any difference to his culpability.

You probably can't find anything because there is nothing to find. I can't think of any legal technicality that would absolve him just because he is in the videos. Again, maybe there's a tangential argument that could be made, something like "I couldn't have been acting recklessly or maliciously because then I'd be doing so with respect to my own content because I'm also in the videos I shared." But such an argument seems undermined by the fact that he's said before he doesn't actually care if his shit gets leaked. If there is a legal argument to be made there, I'd expect it to show up in filings at some point, but I personally think Destiny is just grasping at straws. He also mentioned that he was married to Melina when he filmed the video with Pxie in some convoluted "implied consent" argument (something like, I was married, so Pxie should have known that I would share the video with my wife, at least). This has been said before, but I don't think "implied consent" is even a recognizable concept under the relevant federal statute, and I also don't think there's an exception for sending such videos of another person to one's wife. It doesn't matter who the other person is; consent (or lack thereof) is the focal point.

Edit: Just to provide some further explanation, "consent" is explicitly defined in the federal statute as "an affirmative, conscious, and voluntary authorization made by the individual free from force, fraud, misrepresentation, or coercion." If not requiring outright explicit and verbal consent, that definition seems to require more than just some vague understanding of cultural norms around the sharing of homemade pornography in the community of sex-havers these people were in. And there is a list of exceptions in the statute. I was speaking somewhat flippantly when I said it didn't matter who the other person was. There is an exception for good-faith disclosures to law enforcement, or for other good-faith disclosures as part of legal proceedings, medical circumstances, etc. Unfortunately for Destiny, there does NOT appear to be an exception for sending content to your spouse, or to your really really close friends on discord that you trusted because you spoke on the phone with each other one time.
