In criminal court mistaken believe is 100% a valid defense, since you need to prove intent (most of the time in the form of dolus eventualis, and that implies that you need to at least have seriously considered the possibility of the act being/resulting in a crime and to be ok with that [the easy check for that being, did the perpretrator think "Even if it happens" (intent) or "It wont happen"(no intent)].) I understand you work in European law, I'm not American either, but am familiar with perjury as it pops up now and then in my specific field where I occasionally will consult with legalese re: Gov Acts/Regs. Fun fact in my state, the max financial penalty can be around 1 million USD as well as up to 5 years. The mistake must be about a fact for mistaken belief/reasonable mistake in perjury defence, not the law as I understand it?

The main thing here is the materiality, Pxie claims he did send her vids after the statute, he claims he didn't. Stevens statement is directly related/contradictory to the material of the proceeding and the evidence is looking to falsify his statement. He has claimed he hasn't broken a law, not gotten a tangentially related fact wrong. Materiality or recantation, both can only be used as a defence if its not relevant or impacting the case. None of these apply to that deformed midget.
 
The google drive links could be able to establish specific intent which is one of the more damning aspects of it for the plaintiff’s argument. Since destiny has to think through giving targeted access limited to an individual (who he likely has no explicit consent to give to them anyways) or recklessly disregarding it entirely and “implying” it was meant to be public by providing anonymous links and foisting the blame for the dissemination on others.

At the very least it will be a technical point that can establish a narrative for the how but also the why destiny was actually sharing videos.

Speculating, but I would not put it past destiny to have explicit misdirection to these women he shared the anonymous links to under the guise of “oh no one will know you looked at this if you use incognito now, unless you want me to know :winky face:”

Just as I was starting to believe pxie's attorney's were competent. It appears documents 46 ,47,49, and 51 from friday were filed improperly and required amendment by the clerk. I have no idea if this is standard procedure and expected, but I'm guessing $100k< attorney's don't make these mistakes, which is what pxie is up against.

Bruh i dont get how any attorney can make basic filing mistakes. Yeah, if you start practicing, that shit will happen, but her attorneys are old af. Dont get me wrong, its often the secretary or another law firm employee, who actually files the stuff lawyers write up (and ive even seen secretarys write stuff up themselves), but even then, this shit is embarrasing and sad, since whenever i get hopefull that destiny will get whats coming to him, im brutally reminded how incompetend pxies legal team is. (Thankfully not as brutally tho as what happened to destiny in his youth)

I watched Destiny reading out the latest filing and it's actually pretty funny. A lot of the time he's just reading things in his "soy" voice to signal to the footsoldiers that Pxie's lawyers are bad. There's 2 occasions where he suggests they're letting Pxie write filings herself for practice because it's so bad.
Destiny's on-stream response to the filing really encapsulates who he is as a person. It's clear he was under some pressure to immediately respond because the filing makes him look bad, but he doesn't really have much to say on the substance of any of it, so he primarily just reads the filing in a silly voice, focuses on single words he doesn't like, and picks needless little battles with small and irrelevant things in the filings (at one point, he points out a subject-verb disagreement because he's so desperate for any win he can get; at another point, and this genuinely made me laugh, he started to poke fun at Pxie's lawyer filing her own declaration, until he immediately realized, in real time, that his OWN attorney filed a similar declaration). And this is how he has always been; if he doesn't know the substance, or doesn't think he can win on the substance, he just pivots to any other point where he thinks he has the high ground, even if its largely irrelevant or silly.

And just to briefly address something. Destiny's latest cope appears to be that, because the new evidence was not mentioned in the complaint, it is somehow invalid. Federal rules allow plaintiffs to move to amend their complaint at virtually any point, and the specific scheduling order in this case has set the deadline to move to amend the complaint at July 6.

Destiny doesnt understand that typically, you can file new evidence whenever you want, unless you intentionally filed it late or it would result in significant downsides for the trial (typically if it would lead to a significantly longer trial and isnt materially very relevant). What he means is the claim, which after the trial has started has more complicated rules regarding the ability to change it without the other partys consent.

Thank god that he doesnt evaluate every aspect of his trial legally and doesnt tell his lawyers what to file, that would be so stupid.

Right, if I use my dipshit interpreter, his position is not really that the evidence was filed at this late, late stage (he says, on a motion for a PRELIMINARY injunction one year before trial); rather, its that the evidence arguably wasn't encompassed by the allegations and the claims in the complaint. But plaintiffs can just amend the complaint, and the federal standard is "notice pleading," which just means that the complaint has to include enough allegations to put the defendant on notice as to what he's being sued for; it doesn't have to include every single factual allegation in support of the claim, and it definitely doesn't have to reference all of the evidence that is going to be offered to prove the claim. That's what discovery is for.
