He's characterizing Denims as doing stochastic terrorism to call CPS to his house when in reality she responded to a chatter and said "obviously don't call CPS". Ethan knows this and yet, he said that. The screenshot which he used to link Denims to the CPS call is also doctored, he knows that, he didn't retract it, he in fact used it after finding out it was doctored. He made definitive statements linking people to the CPS call after admitting he has no clue who did it in the Hasan debate, he should know this is damaging. Denims claims to be constantly receiving messages calling her the "CPS girl". She's undeniably receiving reputational damages and you can even see the repercussions of that in Kiwi farms posts.

This is the biggest reason why I hope she actually files the suit. While in a vacuum it's sympathetic that a man who's "kids are being fucked with by CPS" is acting erratically (nevermind the possibility it's a legitimate issue that they got a tip about), that doesn't make it okay to just wildly accuse everyone he's currently feuding with of being responsible, then walk that back when directly pushed on it because he rightly realizes that makes him look unhinged, then push on and continue claiming that anyway after definitively claiming you don't know who did it.

He's muddied the waters, and in a case that as a matter of procedure, he has no idea who's actually made the call reporting him. The problem Denims has with any case is that he never said 'Denims called CPS' so there is no case for defamation. Nothing Ethan said is defamation per-se, which means any defamation would have to have provable damage, which Denims, by her own admission, does not have, she's talked about how she's had more views!

Furthermore, Denims is almost certainly a public figure for the purposes of the lawsuit, which means they'd have to prove actual malice on Ethan's actual statements, which I also don't think they can do.

Speaking of kavanaugh Ethan is appealing to the California supreme court, unlike the appellate courts of appeal that was required to hear the case and which was then subsequently denied and reaffirmed, the CA supreme court is not required to hear the case and has a 97% rejection rate. They will take one look at it and send it back down to the lower courts. btw ethan has NOT SAID ONE WORD ABOUT THIS, strange the mf who cant seem to shut up is non-verbal on this topic.



Ethan already "lost" the federal copyright lawsuit, I put lost in quotations because it was eventually settled out of court but he had to pay a small fine and had to cover his own costs according to him (settlement agreements are usually not public), triller which was suing him was in the middle of an acquisition and wanted to clear house on its liabilities so they washed their hands of that lawsuit but it was on its way to trial after the federal version of anti-slapp was denied. Ethan claimed that he "won" the lawsuit when that is just not true, he had to pay 100s of thousands in legal fees as it had already taken years of back and forth in federal court until it was settled.

Knowing how ethan has disposable income and is willing to drag out legal battles for years, I can see why denims didn't want to file suit and I'm not entirely sure what the outcome would have been, you can win a lawsuit thats awarded $1 in damages just to get the court to agree with you that yes ethan defamed you and I don't see how that would change anything. Not sure why she made the announcement or tried to crowdfund seems a bit sloppy on her part but nevertheless she's apparently refunding the donos and she gave ethan a taste of his own medicine. He's sent out multiple retraction demand letters/dmcas and you are required to do so within a certain time frame if you want to file suit in the future ofc within the statute of limitations after the fact, I think it's like 1-2 years. So as of now she can file suit or a countersuit if ethan files one against her in the future (ethan has been threatening to sue her for months now) since she did submit the retraction demand letter within 20 days. Ethan has done the same to multiple people over frivolous shit like making a youtube video criticizing him or uploading a 1 min clip to reddit, he has not filed suit he's just letting it hang over their heads as some type of intimidation tactic.
