Today, Matthew Hardin had to sit down and think through the ramifications of being hit with the most retarded protective order ever. Then figure out how to politely word the utterly stupid outcomes the court would have to deal with.
The filing is worded a little pettily at parts, in my opinion. But he did a great job at turning Greer's threat into an argument in favor of an extension. Greer is tearing out his hair at that. I wouldn't be surprised if it actually makes him try to get an ex parte restraining order.
 
This is where having a "red line" copy that must be submitted to the court when making an amended complaint would be really, really helpful.
this was an absurdly difficult task to complete. it's not 100% perfect because there's many, many little bullshit inconsistencies that I had to manually even out because the first complaint was a scan I had to also OCR.

I figured I'd share in case anyone else sees something particularly interesting.

maybe a paralegal degree would have helped

Clearly Russ purposely lost IFP status just so he could get it back to flex his superior lawfare skills.
Russ realized that his IFP status would damage his brothel dreams. He was standing there in Winnemucca, all ready to go before the counsel to argue his zoning change request, his mind more on the brothel game than his Kiwi Moon lawsuit, and couldn't afford to look like a broke asshole at that particular moment. Now that he's home in his crusty rental car parked on the side of the road in Las Vegas, he wants his IFP status back, and is willing to certify under seal that he's a broke asshole in order to re-waive the fees.

FWIW I believe Russ is a broke asshole, but broke assholes don't get brothels. Brothels are for closers.

For me, this comes off one of two ways.
  1. Russ knows his goose is cooked so he's going the "Fuck you. If I'm losing, I'm doing it on my own terms" route.
  2. He's banking on the appeal because the judge probably hasn't hit his limit with Russ's retardation like the magistrate has.

Legal Brothels are also businesses with cut throat margins, regulatory compliance requirements, customer service on another level, ability too manage paid employees and contractors, payroll, supplies, utilities, taxes.

Can anyone here seriously think Greer could actually run one? He just thinks it will allow him to get his dick sucked for free. That is about as far as he has thought about it.
 
He really is just blindly copying the language he sees other adults using successfully without understanding it.

It comes across as very cargo-cult-ish. If he says the right magic words that his opponent is using against him, he can turn their magic upon his opponent.

Maybe at a more base level, it's just animal mimicry. Like harmless snakes that "rattle" their tails on dry leaves, yellow-striped flies that resemble wasps, or moths that have similar markings to predators or unpalatable other insects.

Of course for Greer it fails, as usual.

This just strikes me as a shotgun complaint. There's tons of case law on dismissals of shotgun complaints, though I don't know Ninth Tenth Circuit law. Realleging all the paragraphs in each count, especially as he's done it, is a classic sign.

Why would 9th Circuit be relevant?

The District judge took Greer's IFP status so seriously, he reduced a sanction when he wasn't supposed to. It's not unreasonable for Greer to think he'll get a better shot with him, than with the Magistrate who casually bankrupted his brothel dreams with 1 question.

I had to Google how ex parte restraining orders work. If Russ did get one, that probably would mess with Hardin's ability to file motions and conduct his investigations into Greer's activities, at least initially.

Now I am wondering why Russ hasn't tried that sooner. Probably because it was just bluster on his part and he wasn't actually thinking about any of the potential consequences of trying to get such an order.

Greer is actually pretty good at brinksmanship. He (thinks) he has a weapon he can scare with (tell the principal, ask for sanctions, etc) and uses it to scare. But he's smart enough to realize that IF he pulls the trigger, either it works or it doesn't, and if it doesn't, he's fucked, unless he has another.

He's threatened sanctions a number of times, and then when he tried to pull it he got shit on. He'll continue to threaten restraining orders until he is blue in the face, but not actually try for one.

Of course, if he had a restraining order against KIWIFARMS or NULL, they'd not be able to defend the case, and Greer would win instantly. Pity he didn't realize that. <insert AI tithitler here>

Even Greer must know what a dumb move it would be. The judge is not going to be happy if a pro se loon tries to hoodwink the court into kicking out the defendant's lawyer on the grounds of an ex parte and malicious restraining order. He's a federal judge in Utah, not some random person in Las Vegas. The fact that he's threatening this in a legal filing means he thinks the end is near.
 
That's our boy Greer. He doesn't want Hardin to get an extension, because Greer's own extensions have been denied. That's literally the only reason he's protesting.

I don't think that's why Russell is protesting. I think Greer is outraged because Hardin told Betty that Russell stalks women.

He's worried that this has queered his Winnemucca brothel plans. Because every min-wage drudge should be able to launch a luxury brothel in the Nevada desert. Hardin is crushing his dreams.
 
Greer doesn't think the end is near, or that he's on the ropes, or anything. He's mad that his proclivities were once again put on display to the court and thinks this is the proper course of action to remedy the situation and also that he's intimidating the Hardship.
