Judges may feel their work has less weight if their "NO" isn't taken seriously enough to force consequences on someone who commits obscenity or even jokes about 86'ing 45 and 47.
Because the law is words. That's it. It's meaningless outside the illusion of meaning kept afloat by the culture and public education system.
I believe it is possible to recognize the usefulness of such a system without believing there is anything concrete about it. But I guess some more primitive people like to think God or some king set the rules for content.
