There are always factors when it comes to both parents getting arrested. US states loath putting kids into the foster care system because of how much that costs the state. They typically will try to not slam both parents unless they are both so heavily involved in the illegal activity. I agree with you, of course, but the fact that we're all myopically focused on Nick tends to ignore that millions of children are living in even more deplorable conditions. Often its the foster system itself that places them in those conditions where they end up just being a paycheck for some piece of shit. Just consider the fact that literally any crackhead or psychopath can procreate and then you can see where the problem originates and how widespread it is.

That said, there is no reason, NONE AT ALL, that those kids can't be placed in the care of extended family. It sounds like Kayla's family at least has concern for their welfare enough to report what their parents were doing.
