Aaron should obviously offer to settle for a reasonable value in KNU.Yet, I'd be surprised if a Judge awarded more than 10k. Also, if they go in for stupid high damages, the Judge can refuse to award lawyer fees. So, imagine, Nick spends 40k in fees to get 10k from Aaron, but since he asked 250k the Judge declines to award fees, or not full fees, so Nick still comes out at a net loss.
Most states have a rule where if you refuse a reasonable settlement offer and then continue to litigate and get less than when what you received at trial was less than the settlement, you not only don't necessarily get that, but you get to pay the attorney's fees for both sides for the unnecessary litigation you proliferated.
