It technically did have one, but it was ruled unconstitutional. That doesn't remove it from the books, just stops it from applying.
It was a really gay and dumb and unconstitutional statute. It is good it was invalidated.

Unfortunately, Nick is relying on a statute that explicitly is not retroactive, so clearly does not apply to his case. This is such a dumb claim by the defense that it deserves sanctions.

I'm starting to wonder what percentage of Hardin's law practice has become motions to recover attorney's fees and sanctions. It's got to be big enough for its own budget line item now.

He's mostly been known as a FOIA attorney and the FOIA has a fee shifting provision for those who sue to get government information. Seems the MN statute has the same and I suspect some other states are similar. So I'm thinking it's already been a pretty big part of his budget.

My theory is that Randazza took Nick as a client so that he could wring money and misery out of Nick over Nick calling Randazza's partner a faggot, but Nick is too dumb to see it. Furthermore, Randazza should leave Nick hanging out to dry and owing attorney fees more often (for my own personal amusement).

Seriously, what is going on here? I thought Randazza was supposed to be a good lawyer, or at least an effective one. Nick should have fired him ages ago if this is what a grand an hour gets you.

It's funny (and weird) how in more naive times everyone laughed at a certain case where people were hiring SUPERLAWYERS (TM) that turned out to be incompetent wastes of money, but Nick's super-duper-lawyer is even more so.

So Randazza's argument for not showing up is that he thought the filing meant the hearing was off calendar. Reading minn. stat 554.10 it does seem to say all proceedings are stayed, including pending hearings. I don't think the no-show argument is the strongest. How I'm reading it I guess the correct course was to now schedule a new hearing specifically for this motion, and after the order on the motion continue with the scheduling conference. Which seems wildly inefficient. And I'm not sure if a scheduling conference falls under "hearings" or proceedings according that statute, or if I'm missing anything else.

In any case it still seems like a frivolous motion from Randazza.

In any event, it's fucking hilarious and awesome that Nick is paying top dollar for a lawyer who doesn't even bother to show up for hearings.
