I can believe Randazza told him to stop being a sped suggesting frivolous motions, but Nick wanted it anyways.
The fucking nerve of Nick to be talking about Hardin pursuing frivolous action just the other day, whilst pushing his own lawyer do this shit - sniveling hypocritical little rat.

I hope Kayla snaps one day and shoots him in the face.

Another question: When Monty is awarded fees and costs, are they payable via Randazza's professional liability insurance for filing something that had 0 chance of success and failing to appear, or is Nick on the hook for this?

It’s probably because, per his email signature, he had Siri write the email for him. Randazza couldn’t be bothered to type a response with his fingers. I would be surprised if he looked it over at all before he sent it.

Has anybody ever seen Marc Randazza and Russell Greer in the same place at the same time?

Because I'm starting to suspect they might be the same person.
 
I love this part so much, I had to bring it up again today. How funny is it that Hardin is finally getting the paddle out for Nick, when the State obviously just does not care? Someone actually holding Nick accountable for his actions and pattern of behavior? Or at least trying to? 😙🤌

Here's the text:
One of the Defendants, Nicholas Rekieta, appears to have failed to appear in this Court on at least 5 other occasions in recent years, such that this is a recurring pattern. Specifically, a review of the Kandiyohi District Court's dockets reveal that Mr. Rekieta failed to appear on his own behalf in the following cases:

a. State of Minnesota v. Nicholas Rekieta, Case No. 73-VB-24-3399.
b. State of Minnesota v. Nicholas Rekieta, Case No. 73-VB-24-3114.
c. State of Minnesota v. Nicholas Rekieta, Case No. 34-VB-24-522.
d. State of Minnesota v. Nicholas Rekieta, Case No. 34-VB-23-781.

Additionally, this Court's online dockets reveal that Mr. Rekieta failed to appear on behalf of a client in State of Minnesota v. April Imholte, Case No. 73-VB-24-538.

So Randazza's argument for not showing up is that he thought the filing meant the hearing was off calendar. Reading minn. stat 554.10 it does seem to say all proceedings are stayed, including pending hearings. I don't think the no-show argument is the strongest.
It's a fair point, but it sounds like the Court showed up too.

That suggests the Court thought it was still on as well, otherwise they would have issued an order cancelling it instead of showing up themselves.

Randazza may have honestly thought the filing paused the hearing, it's a plausible defense against Greer-level sanctions. But maybe he should have included a Motion to delay or cancel it along with his anti-SLAAP filing. I don't know if the rules require it, but given the confusion maybe it was warranted. Either way Hardin spent time in good faith, since he attended same as the Court, so he deserves to make the argument for fees.

I wonder if Nick’s plan is to stall. Is Randazza’s bad filing able to be appealed? If so they could do an interlocutory appeal and just drag this shit out.

Basically Nick might be gambling that he can be retarded longer than Monty can pay Hardin (I fucking doubt it with all the lawsuits Nick is threatening).

Sir he is a REAL HUMAN BEING with FEELINGS. Council just wants to move on from this ridiculous hearing, it's frivolous to keep jumping on every word when he already admitted he goofed.

Actually I think he should have called it a misunderstanding, since it's not clear whether the hearing actually should have been put on hold or cancelled. "Error" is a word you use when you meant to do something specific but wound up doing something else. But Randazza didn't forget or accidentally delete a calendar entry, he intentionally ignored the meeting. If he thinks there was good reason to assume the hearing should have been cancelled by the court (and it sounds like there is), then the outcome was a result of parties interpreting the law differently, not his own error.

That's the kind of distinction a big shot lawyer should love to argue about and have a response about immediately, even if he's being professional in emails. I get the impression Randazza is phoning it in a bit.

This is what local counsel is for. They know the rules of the local court, and they are supposed to keep hotshots like Randazza on the leash. We all know Randazza was partying it up (on another client's dime) in Boston while he was supposed to be working for Nick.

He should have just called up the court and checked. If it wasn't canceled then he was required to appear.
 
The best part is knowing how fucking furious Nick was to read Hardin’s filing. I’m really not surprised he couldn’t bring himself to go on camera last night despite his promise to stream. Nick was solely focused on seething.

Imagine what a pleasant evening the children must have had as hostages of this self-centered ragebeast.

It would be so funny if Nick tries to use this fuckup as a pretense for withholding payment from Randazza. He’s certainly done dumber shit.

If he had any sense, he would never have hired Randazza for this anyway. He would have hired some local willing to look past what a piece of shit he is and settled.
