I think it's safe to say that we can no longer take Minnesota court for granted. If this mess took place anywhere else in the country, it would be over with by now.

Also, I don't believe Aaron's take that the county is being lenient on Rekieta because they don't want to sour their reputation. The county is already supposedly notorious for being a low class environment full of druggies, why would on slightly above average profile case ruin what's already ruined?

That doesn't seem right. If you're charged with something criminally, why should you then be targeted civally? It seems it should only be one or the other.

Edit: When I say "right," I mean fair. I believe that this legally true in Minnesota, but It seems wrong (from a fair sense) that you can plead guilty and then get punished for it. The idea of guilty pleas is to reward people for coming clean.

Its why OJ got sued by his ex-wife's family and lost a bunch of money. Our criminal justice system is designed to return circumstances to where they were before they happened, or a reasonable facsimile of. If you dinged someone's car the state could punish you for reckless driving, then the person you hit could get money to repair their vehicle. If you damage someone's reputation in a way society at large has deemed illegal, then the state will slap you with sanctions, and the affected party can attempt to gain monetary reparations to repay the reputational damage you did to them.

Of course Aaron showed 1 picture to 1 guy 1 time, and didnt distribute it to the public, and as far as Im aware hasnt actually talked about the victim (Kayla) at all since he was told not to. The really unfair part here isnt that Kayla can sue him, its that Nick is going to weaponize the civil justice system to bankrupt and life-ruin Aaron. Hopefully hes got a deceny lawyer that can articulate to a judge that Aaron's worst crime was sticking his dick into crazy (nick).

Nick Rekieta is still a disgraced former lawyer, who's child tested positive for cocaine, who verbally abuses and makes sexually inappropriate statements about women (and aaron), who knowingly let a pedophile and a domestic abuser around his kids, who talked openly about raping people who oppose him, and enjoying child rape anime.

Nick is still Nick. He's not winning, just dragging Aaron down with him. Not the biggest loss in the world :story:

Yes. And all of that would take time and effort to prove. As long as this remained a $50 misdemeanor case, it would not be worth the cost and effort to prove it.

As Nick ramps this up, it becomes worth Aaron's time and effort to introduce Stearns County to the Lore of Balldo. We've seen introducing courts to our lore is a long and difficult and costly process. It can be done, but is it worth doing?

From what I have seen, it really seems like Todd Peterson, Aaron's lawyer, really fucked him here by both failing to advise Aaron properly when it came to the terms of the consent order and by failing to properly read the temperature of the court.* The catty letter also did not help.

* I am also fairly confident Todd Peterson did not properly explain the collateral consequences if Kayla wanted to pursue a civil suit based on this latest news and Aaron's behavior.
But it's not going to be "upgraded" to a felony—he was initially accused of a felony to begin with. It would only revert to that if the prosecution or the defense calls the deal off, no?
The judge can also unilaterally yoink a plea agreement if the judge thinks it would believes it would not be in the interest of justice.
Is Aaron still in a position where he can withdraw his plea?
Apparently under the Minnesota rules, he can withdraw a plea before sentencing if it would be fair and just to do so.

Is Aaron still in a position where he can withdraw his plea? Here (and I think most places) he would require leave of court, but the rules of criminal procedure seem pretty whacky up there. Some of the judges here will always allow you to withdraw your plea if they won't accept it (the correct move, IMO - the plea was almost always fully induced by the offer and ambushing people with a new sentence has a chilling effect on people's willingness to make pleas). But, this judge seems like the kind of guy that likes to trip people up.
I think Minnesota has law on the books stating you can do that anytime based on ineffective counsel. The “not talking about” is a violation right?

I don’t know if it’s a dick move, but throwing a lawyer under a bus in a case like this feels like something his lawyer could explain.

State v. Kellens (2022) and State v Hoflock (2024) seem to support that on Minnesota.

After this weak argument, the judge laid into Aaron. Said the conditional release order was clear and he broke it. It is a public safety issue. She increased Aaron’s bail.
What was the violation? I still can’t figure that out, when did I he talk about her?

Either way, I still consider this a Nick and Melton L. Solely because someone being in jail before bail is somehow the highlight of their year.
