FRISCO, Texas — Karmelo Anthony, the teen accused of fatally stabbing another teen, Austin Metcalf, at a Frisco track meet, has been indicted on a murder charge, officials said.

A grand jury indicted Anthony on Tuesday, according to the Collin County District Attorney's Office. A murder charge is punishable by 5-99 years or life in prison.



Anthony, a 17-year-old former student of Frisco Centennial High School, was arrested and charged with murder in the fatal stabbing of Frisco Memorial High School student athlete Austin Metcalf in April at a track meet in Frisco ISD's Kuykendall Stadium. He was released from jail later that month after his bond was reduced from $1 million to $250,000.

Anthony has claimed self defense in the case, which garnered national attention, heightening racial tensions and raising security concerns among everyone connected to the case, including both families and Judge Angela Tucker, who is presiding over the case.

"We know this case has struck a deep nerve — here in Collin County and beyond," Collin County District Attorney Greg Willis said in a statement Tuesday. "That’s understandable. When something like this happens at a school event, it shakes people to the core. But the justice system works best when it moves with steadiness and with principle. That’s what we’re committed to. And that’s exactly what this case deserves."

Anthony's attorney, Mike Howard, called Tuesday's indictment "an expected and routine step in the legal process."

"Karmelo and his family are confident in the justice system and the people of Collin County to be fair and impartial," Howard said. "Of course, Karmelo looks forward to his day in court. It's only in a trial that a jury will hear the full story, one that includes critical facts and context that the grand jury simply didn't get to hear."

Howard again raised Anthony's self defense claim in his statement Tuesday.

"We expect that when the full story is heard, the prosecution will not be able to rule out the reasonable doubt that Karmelo Anthony may have acted in self defense," Howard said. "Self defense is a fundamental right guaranteed every American."



Metcalf's father, Jeff Metcalf, told WFAA in a statement that he's "pleased that we are moving forward."

“With the first degree murder indictment, it now goes into the court system," Jeff Metcalf said. "I fully believe that justice will be served for Austin Metcalf. I look forward to the forthcoming trial. But it will never bring my son back.“

Under his bond conditions, Anthony is required to wear an ankle monitor and ask permission to leave his home. If Anthony violates any conditions of his bond, he will have to return to jail. He graduated and received his high school diploma in May, but did not attend the ceremony, WFAA previously reported.

Anthony allegedly confessed to the stabbing immediately after he was arrested, claiming he was defending himself from Metcalf, officials said, as WFAA previously reported.

A witness reportedly told police that Metcalf told Anthony he had to move out from under the Memorial High School tent. Anthony responded by opening his bag and reaching inside, WFAA previously reported.

"Touch me and see what happens," Anthony told Metcalf, according to a witness.

Metcalf reportedly then touched Anthony, the witness told a responding officer, and Anthony told Metcalf to punch him and see what would happen. Soon afterward, the witness said, Metcalf reportedly grabbed Anthony to tell him to move. At which point, the affidavit continues, Anthony reportedly pulled out what the witness recalled as a black knife and stabbed Metcalf once in the chest before running away.

The deep tension sparked by the incident has raised concerns that the case may be tried outside of Collin County. Collin County District Attorney Greg Willis told WFAA that the judge will make that decision at the time of trial.
 
Why is the forum against a court appointed attorney? Wouldn't that work against Karmelo, since court appointed attorneys are not as good as paid attorneys? You want someone to lose a court case, however you are against a court-appointed attorney.

You have no idea at all what you're talking about. Gideon reversed a former case, Betts v. Brady, which held that it was not violative of the 14th Amendment for a state to deny appointed counsel to an indigent client. The Gideon Court said:

I do not believe you are arguing in good faith or even from a position of ignorance because of how purposefully retarded you are.

For anyone else: Karmelo Anthony may assert to the court that he is indigent, and that his parents will not provide him any money but have abandoned him to prison. The court will obviously question that. His parents raised a bunch of money for his defense and then abandoned him? That doesn't pass the smell test. But it could be true—and the judge will likely inquire into it because of the absurdity of the proposition—in which case he will be provided with appointed counsel. But there is no right to counsel if you are not indigent, and someone whose parents raised a ton of money for his defense is not indigent absent some crazy misconduct that the judge wouldn't believe without looking into it himself.

Gideon v. Wainwright says the right attaches when the defendant cannot afford counsel at the time of trial. The court can deny counsel based on fraud or willful dissipation, that is, proof the defendant purposefully gave away assets to qualify for free counsel.

So let's stop being angry niggers and use our brains:
  • It is a fact that a minor is almost never considered financially independent in the eyes of the law.
  • If a minor’s family controls or spends money meant for defense, it cannot be blamed on the minor.
  • The minor's actual access to funds at the time needed for a defense attorney is the only question unless Karmelo somehow personally had control and willfully dissipated or has himself engaged in fraud.
  • His family doing shit means they're separately responsible for their crimes.
  • In re Gault (1967): Juveniles facing delinquency proceedings have the same right to appointed counsel as adults do.
THEREFORE
  • If Karmelo is a minor and his parents control the gibs (and squander it), he is indigent if he has no actual access, regardless of how much was once raised.
  • Karmelo is obviously not responsible for what his retarded family does, just like they're not on trial for his murder of Metcalf.
  • Even if the situation pisses you off or fails smell tests (for multiple reasons), the court must appoint council unless there is direct evidence Karmelo himself, not his family, committed fraud or is hiding assets.
  • It is fucking absurd for a minor to be responsible for their parent's bullshit because he never had access in the first place because they're a minor.

I complained that his family should take care of their own fucking kid, instead of using their murderer kid as an excuse to get a pile of cash and spend it on bullshit. I think a defense atty might actually step in to make a name for himself because that's what they do. It's their job. It's high profile. If he does everything right, even if he loses, he'll have a stronger career.

Your concept of how this works is so wrong it borders on the obscene. There is a means test for appointment of council. It is perfectly constitutional. You cannot say "I can pay for my own attorney I just don't want to. I want the taxpayers to do it."

Yes, but, his status as a minor ultimately means he is not a financially independent entity. Minors can't open their own bank accounts, minors can't enter into their own employment contracts, minors can't get their own lines of credit. Etc. And that status does not then transfer to the family.

So no matter how rich his family? If they decline to give him money? Then he is, under the law, indigent, aside from whatever cash he might have on him from a newspaper route. And that's clearly not going to be enough for even a regular old attorney.

There is no law that says a parent must bail out their kid if they can "afford" it. If there was? It'd be illegal to withhold a promised allowance for not doing your chores.

My parents told me growing up that if I ever knowingly and willingly broke a law? I was on my own, they were not going to pay for bail or a lawyer or anything. Even though they could have afforded one. And that's a completely legal stance to take.

But? Since they claimed "legal defenses" as part of the grift? The Judge may put them on the spot where they have to either admit they lied and get rung up on fraud, or admit that's what the money was for and they either squandered it (fraud again) or have enough left to hire at least a regular attorney.

Had they kept their traps shut (difficulty for niggers who won the ghetto lottery: impossible) they probably could've cut him loose without an issue.

This is a really common misconception, but no. Court appointed attorneys are not inherently worse than paid ones. Many are true believers in the system who throw their heart and soul into the case. Many are private attorneys getting paid from state funds set allocated to paying PDs, meaning they’re the same attorneys as the ones you can pay for. And some are dipshits who are awful at their job.
But the exact same is true for paid attorneys. There are plenty of amazing ones, and plenty of cons who are going to run up fees and are awful at their job. You might be paying for a Perry Mason, you might be paying for a Saul Goodman, or you might be paying for someone who graduated at the bottom of their class and barely passed the bar and had to hang up their shingles straight out of law school.
