Well, some of the characters have defined ages, such as Sumireko, who's a 15-year-old highschooler from Tokyo. Others have ages that are unknown, but can be inferred to be at least (X)ty-years-old, such as Reisen having fought in a war in 1969, and since Sumireko possesses items that can only exist in the modern era like smartphones and a 3D printed Liberator pistol, we can infer that's Reisen is WELL above the age of 18.
The strongest argument he could put forward is that ZUN signed off on Touhou Lost Word and that being a gacha comes with all the skins you'd imagine. It'd still be a weak argument because ZUN has zero control over what skins get put in, as far as I know.

But it is true that he stole poses and ideas from Rance games, which were at the time text adventure games for the PC-98. He also stole a lot of shit from some mangas that I haven't checked myself personally, but the games are pretty innocent barring some jokes and the fact that there may or may not be underage drinking. I still recall that one of the entries for Subterranean Animism goes over his thought process for giving Utsuho the nuclear rod and stone leg (Because he wanted to avoid the design of Yatagarasu being lewd with an actual third leg).
