I fully expect SCOTUS to bitch out on this, and Trump to go for the final gambit: Elevate illegal immigration to a proper foreign invasion by foreign adversaries and start rolling military tribunals for war crimes or prisoners of war using whatever justification possible. Thus they were never within the jurisdiction of the USA.
That's the only way I see it winning, and even that seems like a stretch. I'll find me a burger suit if SCOTUS actually delivers and slaps it down, but I fully expect deflection again in the form of blocking the class action angle before they stand firm on anything. I just don't see any reliable way around the definition of jurisdiction as the country currently operates.
