I haven't posted in this thread for a while because Destiny laughing at Pxie for crying while giving evidence really made the case un-fun to pay attention to. But I checked the court records and saw the most recent motion.

I am a little late but this amended complaint is a massive massive deal. First it brings the timeline of the case back to square one basically in terms of the legal timeline of how a case should proceed.

But the biggest and most important thing this does is establish and clear and airtight chain of custody for the porn being leaked by Destiny while ensuring that the signage date of the revenge porn law is not too late.

As @Potentially Criminal and @mindlessobserver have noted Pxie might have some issues in some of the steps of proving Destiny shared these videos and him sharing them led to them being spread. She has proof he uploaded it to a google drive link which was public past the date. She has proof that he made the google Drive as public as possible. She has proof that the videos being spread on the internet came from the Google drive link. From X to Y to Z in an unbroken chain. I would try and compare the meta-data on the porn-site versions and the KF version just to really drive home the point if I could, but she shouldn't need to as the dates of upload will be enough.

Secondly even if she isn't granted this is basically a dotting i and crossing ts sort of motion because she doesn't need an amended complaint to use this evidence but it makes it EXTREMELY hard to dismiss in case Destiny tries to dismiss it for subject matter jurisdiction. Even if the Court doesn't grant the amended complaint they still won't be able to dismiss for that reason because they tried to amend and it would be extremely unfair. Pxie's lawyers even made sure the motion to amend is timely to the court's deadline.

I think we can lay to rest the notions of Pxie's lawyers being incompetent. They established everything they need to make their case already and they are covering all their bases and making sure they don't snatch defeat from the Jaws of Victory.
