The account in question is one that Destiny believes to have been used to fake evidence, and according to him, was likely used recently to change the settings so it would conceal when it was being used to view this thread. Depending on when the account was last logged into, which Destiny speculates was like two days ago in the aftermath of him pointing it out, then he should still be able to subpoena an ip address I feel like.

So even if Rose's account was the only one who could open that discord sex video of Pxie , when did destiny make that discord sex video accessible to Rose?
The date at which he first made the Pxie sex video accessible to Rose was on the 10th April 2022, but he also made that video accessible to Rose every subsequent day that he kept that discord message up without deleting it. So he also made the video accessible to Rose on the 11th of April 2022, 12th of April 2022, all the way until the 1st of October 2022 when 15 USC 6851 came into effect, and after that until 2024.
If destiny had instead deleted the discord message to Rose with the sex video in say August 2022, then it would not be true that on or after the 1st of October 2022 he was making the sex video of Pxie accessible to Rose and he would definitely be in the clear on that charge.

It really depends on who is making the adverse inference. If its the jury at trial, it then depends on what the court instructs them to do. The court could instruct them that they must draw an adverse inference from him deleting/not preserving the texts, which I suspect would lead to them assuming that he sent the videos to Abby. Or the court could instruct the jury that they may draw an adverse inference, and then it's just up to the parties to try and convince the jury what actually happened.

That being said I do kind of suspect the District Judge is being slow on purpose to try and let this case cool down a little bit and to signal to both sides to calm down a little bit.

I agree with most of what you said, but its actually the magistrate judge that is being "slow" here (I put "slow" in quotations, because I'm not actually sure the judge is being slow relatively speaking). Every currently pending motion, including the motion for a preliminary injunction, the motion for a protective order, and the motion for leave to amend the complaint, has been referred to the magistrate judge for initial review and disposition. And the magistrate judge has authority to issue a ruling on the protective order and the amended complaint without first issuing a recommendation to the district judge (although, the parties could still appeal his rulings to the district judge, as you noted).
