Honestly, opposing this particular motion seems like a Hail Mary. I wouldn't have been surprised if they just didn't oppose it, but, as Destiny has said in the past, it seems like their strategy is to oppose everything. Opposing it makes sense, but it seems like their argument re: the abbymc allegations is just to say they are false or unsupported by current evidence in the record; neither of those facts are a reason to deny leave to amend because the court's obligation is to assume the newly alleged facts are true. They say the amended complaint wouldn't survive a Rule 12 motion but, if that's true, why have they never filed one? Even Destiny said they didn't file a motion to dismiss early on because they thought it would have been denied. That's the real reason they haven't formally asked the court to dismiss the case imo, because, if the court denies a formal request to dismiss the case, that runs counter to Destiny's musings that the case has been dead for months.
